CJI Gavai says Article 370 went against Ambedkar's vision of one Constitution for India

Nagpur: Chief Justice of India Bhushan Gavai on Saturday said the
's unanimous verdict upholding the abrogation of Article 370 to revoke special status for Jammu and Kashmir was consistent with Dr BR Ambedkar's vision of a single Constitution for a unified India.

He added that two constitutions for one country was never the vision of the chief architect of the statute.
"We judges upheld the govt's decision to abrogate Article 370 to ensure that India is governed under one Constitution," he said, calling the judgment an important affirmation of Ambedkar's ideology. Justice Gavai was speaking at the inauguration of the Constitution Preamble Park at the Nagpur University's School of Law.
Justice Gavai emphasised that though judges usually refrain from discussing their judgments in public, the Article 370 ruling was of such constitutional significance that it merited reflection. He said it aligned with the foundational principles laid down by Ambedkar, who firmly believed in unity through a single legal and constitutional framework.
"During the Constituent Assembly debates, Dr Ambedkar clearly said India should not follow the American model of separate constitutions for the Union and states.
He believed in one nation, one Constitution, and that's the philosophy we reinforced in the verdict," Gavai said.
He further said even amid turmoil and constitutional breakdowns in neighbouring nations of Pakistan, Bangladesh, Nepal, and Sri Lanka, India has remained united and democratic because of the strong constitutional edifice built by Ambedkar and his fellow framers. "Our neighbours have witnessed coups, collapses, and severe instability, but in 75 years, India has stood firm — thanks to the inclusive and progressive framework of the Constitution," he said.

Accompanied by Union minister Nitin Gadkari, Maharashtra chief minister Devendra Fadnavis, revenue minister Chandrashekhar Bawankule, minister of state Ashish Jaiswal, and Bombay High Court's Nagpur bench judges including Nitin Sambre, Anil Kilor, Abhay Mantri and Justice Sanjeev Kalgaonkar of MP High Court, the CJI said he felt deeply honoured to inaugurate the Preamble Park during the Constitution's platinum jubilee year and during his first visit to Nagpur as the country's top judge.
"The drafting of our Constitution was not merely a legal process, but a social revolution. Babasaheb worked for over two-and-half years to craft a document that gave voice and dignity to the weakest sections of society," said Gavai. He pointed out how Ambedkar ensured that social, economic, and political justice were embedded in the very Preamble of the Constitution.
Visibly emotional during his speech, Gavai said he was proud to have recently unveiled Ambedkar's statue at the Supreme Court, and even more privileged to inaugurate the Preamble Park in Nagpur — the very city where Ambedkar led a historic socio-religious revolution by embracing Buddhism in 1956.
Recalling landmark constitutional decisions, Gavai also referred to the Kesavananda Bharati case, which established the doctrine of basic structure. This doctrine states that while the Parliament can amend the Constitution, it cannot alter or destroy the "basic structure" or fundamental features of the Constitution. "Justice Mudholkar, who hailed from Nagpur, was among the first to articulate that the Constitution had a core that could not be altered.
This idea was later reinforced by the Supreme Court, ensuring that fundamental rights and democratic principles could never be diluted," he explained.
He described Preamble Park as a living monument to constitutional values, built not just to commemorate history but to inspire future generations. "The murals, Ambedkar's quotes, and visual elements in this park will help citizens internalise the ideals of liberty, equality, justice, and fraternity," he said.
Gavai lauded Dr Ambedkar School of Law for its exceptional legacy of producing legal luminaries, including two former Chief Justices of India — M Hidayatullah and Sharad Bobde, many chief justices, and eminent lawyers. "This is a unique institution. Though I didn't study here, it feels like home. The college has contributed immensely to India's legal system," Gavai noted.
The CJI also paid heartfelt tribute to his father, former Governor and MP RS Gavai, and senior Ambedkarite leader Dadasaheb Kumbhare for their lifelong commitment to social justice and the Ambedkarite movement.

Preamble Row Flares Up- After Tharoor's 'RSS Moved On' Bombshell, RJD Slams VP Dhankhar's Comments

/ Jun 29, 2025, 07:05PM IST The ongoing Preamble debate has intensified, with sharp political exchanges following remarks by Vice President Jagdeep Dhankhar, who said the Constitution's Preamble was altered during the Emergency to add "socialist" and "secular," calling preamble the 'seed' of the Constitution. RJD MP Manoj Jha hit back, asking if the issue is with the words or their inclusion. Earlier, Congress MP Shashi Tharoor had responded to Rahul Gandhi's 'Manusmriti' tweet, noting historical RSS criticism of the Constitution but claimed the RSS has 'moved on.' The row was first triggered by RSS leader Dattatreya Hosabale, who questioned the additions during an Emergency anniversary event.#preambledebate #indianconstitution #jagdeepdhankhar #socialistsecular #emergency1975 #samvidhanhatyadiwas #manojjha #shashitharoor #rahulgandhi #dattatreyahosabale #constitutionofindia #basicstructuredoctrine #indiraGandhi #indianpolitics #democracy #secularism #socialism #india #constitutionalamendment #parliament #supremecourt #rss #congress #rjd #toi #toibharat

Iran casts doubt on Israel's ceasefire commitment after 12-day war; demands UN name aggressors

Six days into a fragile ceasefire brokered by the United States, Iran on Sunday said it does not trust Israel to uphold its end of the truce, as both nations continue to reel from the most violent confrontation in their history. The 12-day war, triggered by an Israeli bombing campaign that targeted Iran's top nuclear scientists and commanders, has left hundreds dead, diplomatic efforts in disarray, and fresh geopolitical scars on an already tense region. 'We have serious doubts over the enemy's compliance with its commitments including the ceasefire,' said Abdolrahim Mousavi, chief of staff of Iran's armed forces, in a statement aired by state television. 'We are ready to respond with force if attacked again.' The conflict began on June 13, when Israel launched what it called a pre-emptive bombing campaign targeting Iran's nuclear infrastructure. It claimed the strikes were aimed at preventing Iran from acquiring a nuclear weapon—a charge Tehran has consistently denied. Iran accuses US and Israel of aggression In a strongly-worded letter to UN Secretary-General Antonio Guterres, Iran's Foreign Minister Abbas Araghchi urged the United Nations Security Council to officially hold Israel and the United States responsible for initiating what Tehran described as an act of aggression. 'We officially request that the Security Council recognise the Israeli regime and the United States as the initiators of the act of aggression and acknowledge their subsequent responsibility, including the payment of compensation and reparations,' Araghchi wrote. The US military had joined Israeli forces in the campaign, carrying out airstrikes on three of Iran's key nuclear facilities during the conflict. American President Donald Trump, who announced the ceasefire last week, had also threatened further strikes if Iran resumed uranium enrichment at weapons-grade levels. Nuclear talks derailed, casualties mount The war has derailed nuclear negotiations between Iran and the United States, talks that were already hanging by a thread after the US withdrawal from the 2015 nuclear deal in 2018. According to the International Atomic Energy Agency, Iran had enriched uranium up to 60% purity in 2021, well beyond the 3.67% limit set by the original agreement but still short of the 90% threshold needed for weaponization. Meanwhile, the human toll of the war continues to emerge. Iran's health ministry said on Sunday that at least 627 civilians were killed and 4,900 injured in Israeli airstrikes. In retaliation, Iranian missiles killed 28 people in Israel, according to official figures from Tel Aviv. Iran also arrested dozens of alleged Israeli spies, claiming to have seized weapons, drones, and surveillance equipment during security operations conducted alongside its retaliatory military actions. 'Unacceptable': Strike on Evin prison draws global criticism Among the most controversial strikes of the conflict was an Israeli missile attack on Tehran's Evin prison, which Iran's judiciary confirmed on Sunday killed at least 71 people. The victims reportedly included prison guards, administrative staff, inmates, visiting relatives, and civilians in nearby buildings. Iranian officials said the strike destroyed part of the prison's administrative block, sparking an international outcry. French Foreign Minister Jean-Noel Barrot condemned the bombing as 'unacceptable,' though confirmed that detained French nationals Cecile Kohler and Jacques Paris were unharmed. Evin prison, long known for holding political prisoners and dual nationals, also houses Nobel Peace Prize laureate Narges Mohammadi and several European citizens. Authorities later said inmates had been transferred, but did not disclose how many or to where. Crackdown on foreign tech and internal dissent In a further sign of tightening internal controls, Iran's parliament on Sunday passed a law banning unauthorized use of communication tools, including Elon Musk's Starlink satellite internet service. The move follows reports of protesters and independent journalists using Starlink to evade state censorship during the conflict.

Want to contest Assembly polls for the sake of Bihar: Chirag Paswan

Rajgir (Bihar): Union Minister Chirag Paswan on Sunday asserted that he wanted to contest the upcoming assembly polls "for the sake of Bihar," unfazed by what he called "jittery" detractors trying to put hurdles in the way. The Lok Janshakti Party (Ram Vilas) president addressed a rally titled 'Bahujan Bhim Sankalp Samagam' at Rajgir, in Chief Minister Nitish Kumar's home district of Nalanda. The Hajipur MP urged the people to be on guard against the "false narrative" of the opposition INDIA bloc, which had "alleged during the Lok Sabha polls last year that the Constitution will be under threat if Prime Minister Narendra Modi got a third consecutive term". "They are trying to play the same trick again in the run up to assembly polls. But you must remember that the worst attack on Constitution came during the Emergency when the Congress was in power and countless young men, mostly Dalits, minorities and OBCs, had been forcibly sterilised", alleged Paswan. He added, "Today the Congress and its allies are busy trying to present themselves as the champions of minorities by attending a rally in Patna where they are opposing the Waqf Act which had been brought for the benefit of poor Muslims. They should be asked about the Turkman gate massacre". Live Events Launching a frontal attack on RJD's Tejashwi Yadav for "allying with the Congress just for the sake of power", the Union minister challenged him to "seek an apology from Rahul Gandhi for excesses during the Emergency, the sufferers of which include his own father (RJD president Lalu Prasad)". Mocking Gandhi for carrying "a red copy of the Constitution", Paswan charged the Congress with having ignored, while in power, the contributions of Babasaheb Ambedkar . "It was the government of VP Singh, supported by the BJP, in which my idol and father late Ram Vilas Paswan a minister, that Bharat Ratna was given to Babasaheb, his picture was installed in Parliament and the report of Mandal Commission, put by the Congress in cold storage, was implemented", he pointed out. "The opposition keeps raising the false alarm that reservation will be scrapped. Let me give you the guarantee that this is not going to happen, as long as Chirag Paswan is alive", he added. The LJP(RV) president said that his interest in politics of the state was symbolic of "people returning to their home after having been forced to flee because of the lawlessness that prevailed under RJD rule ". "Many people are jittery that I want to come to Bihar. They are trying to know whether I will be contesting elections here. I wish to tell them, I want to contest assembly polls for the sake of Bihar. So that my dream of Bihar First, Bihari First is realised", said Paswan. He added, "Hurdles are being put in my way. But I am not going to dissuaded. Earlier attempts to break me by causing a split in my party and a rift in my family have failed to dishearten me. I urge my party cadre to fan out across all 243 assembly constituencies and fight for the victory of NDA, with the intensity as if Chirag Paswan were himself in the fray. You give me NDA's victory in assembly polls. I will give you a developed Bihar".
