The victim (who cannot be named due to the nature of the charges) testified that she and Thabethe had sex several times.
In his plea, Thabethe told the court that he was in a consensual relationship with the victim, and also formally admitted that she was 13 years old at the time of the offence.
He further denied they had sex multiple times and said they only had sex once.
The victim testified that she met Thabethe in 2023, when he was visiting a friend in the same street as her. She said he asked if they could date, and she told him she was only 13 and was too young. Thabethe allegedly told the girl her age didn't matter to him.
The victim's parents pleaded with Thabethe to stay away from their daughter due to her age. When they realised their plea had fallen on deaf ears, they opened a case with the police. Thabethe was then arrested.
He testified to the court that he was under the impression the victim was 19 years old, as per her Facebook profile. The victim replied by saying that she only wrote that she was 19 so she could open a Facebook account.
Magistrate Deon Minnie stated that when the victim testified, she appeared to be a child under the age of 16, and did not give off the impression that she was older, 'This was so obvious that it must have been the same impression the accused had of the child's age as well,' he said.
He further added that any reasonable person, under these circumstances, would have at least taken the steps to confirm the victim's real age despite her appearance, in light of knowing that having sexual relations with a person under 16 is an offence.
• Thabethe was then found guilty on the charge of statutory rape. It was further stated that he was negligent for failing to enquire about exactly how old the girl was.
• The matter was postponed to August for sentencing.

The forum also urges seniors to join elderly organisations, and to speak up at meetings. 'If they keep quiet, the stress builds up. We want them to share so we can help.' A grieving family brought a dead body in a coffin into Capitec Bank at KwaDukuza Mall on Tuesday in protest over an alleged funeral insurance payout delay. North Coast Courier reports that, according to the family, they filed the claim last Wednesday and were initially told payment would be processed within 48 hours. They were later informed funds would only be available by August 22, nearly a month later. Feeling helpless, the family made the drastic decision to take the deceased to the bank to highlight the emotional and financial burden caused by the delay. The incident shocked shoppers and staff, drawing concern and sympathy from onlookers. A 43-year-old woman, sister of the 25-year-old deceased, expressed deep disappointment in the bank. 'We have to bury my sister this Saturday. Since they say they will only pay on the 22nd of next month, we brought her body to prove she has passed. I am worried because my whole family is insured with this bank.' This is not the first time such an incident has occurred in KwaDukuza. In 2019, a family from Madundube took a body to an Old Mutual branch under similar circumstances. Old Mutual said the claim had already been processed but acknowledged delays and apologised. KwaDukuza Mall management distanced itself from the matter. Soldiers mourn loss of fellow private in tragic elephant-related incident in Limpopo The death of a private, a member of the 10 Anti-Air Regiment, has been confirmed by the South African National Defence Force (SANDF). Pretoria Rekord reports that Xavier Raynard was deployed under Operation Corona in the Madimbo area of Limpopo. He was found dead near the Yellow Gate of the Madimbo Operational Base on Sunday afternoon. Preliminary reports indicate that he may have been fatally trampled by a herd of elephants while conducting routine patrols in the challenging terrain. The Madimbo Corridor is a northern military base in Limpopo that borders Zimbabwe and is near nature reserves. It is controlled by the SANDF and is used as a military training zone. Raynard was carrying out a patrol along the Malala Drift Road when he was killed. Rear Admiral Prince Tshabalala, director of Defence Corporate Communication, says his service weapon was recovered at the scene. The SANDF is investigating the incident in collaboration with environmental and wildlife authorities to establish what the full circumstances were. Tshabalala confirmed a formal board of inquiry has been launched to provide clarity and accountability. Minister of Defence and Military Veterans Angie Motshekga, chief of the SANDF General Rudzani Maphwanywa, and acting secretary of Defence Dr Thobekile Gamede have extended their condolences to Raynard's family, friends and fellow soldiers. Tshabalala pointed out that the SANDF is providing psychosocial support to the family and members of his unit during this difficult time.
