Prison with no parole eligibility until 2034 for man who killed migrant worker girlfriend

Yahoo5 days ago
Life imprisonment with no chance of parole until September 2034 is the sentence for a Honduran man who stabbed his migrant worker girlfriend 48 times.
David Enrique Espinoza Montes, 41, showed no emotion as he received his sentence in a courtroom at the Superior Court of Justice in Windsor on Wednesday.
Justice Joseph Perfetto described Espinoza Montes' crime as "particularly callous and senseless," and said the attack itself was "gratuitous and vicious."
"There is no question (the victim) was terrified," Perfetto told the court. "There was no mercy shown to her."
But the judge said he believes that Espinoza Montes' expressions of regret are sincere.
"In my view, Mr. Espinoza Montes has insight into his offending, and the deep impacts associated with it," Perfetto told the court.
"I am satisfied that Mr. Espinoza Montes is remorseful for his conduct."
The killing of 33-year-old Shermaine Carling occurred on Sept. 29, 2022, in a rooming house in Leamington.
According to the agreed upon statement of facts, Espinoza Montes attacked Carling in a jealous rage after learning she had been seeing another man.
Espinoza Montes inflicted 48 stab wounds on Carling's neck, torso, and back using a kitchen knife and a pair of scissors.
Immediately after the attack, Espinoza Montes remained at the scene and surrendered himself to police.
Earlier this year, Espinoza Montes pleaded guilty to a charge of second-degree murder. The charge carries an automatic life sentence in Canada.
Perfetto agreed with a joint sentencing recommendation from the Crown and the defence that Espinoza Montes should not have eligibility for parole until 12 years of incarceration.
Espinoza Montes has been in custody since his arrest almost three years ago.
Perfetto said the offender entering a guilty plea was the most significant mitigating factor in the sentencing, as it spared Carling's family — which includes two children — from the hardship of a trial.
Perfetto noted that Espinoza Montes had no prior criminal record, and has been participating in counselling and anger management programs at the South West Detention Centre.
"Other than this offence, there is no evidence that he is a violent person," the judge said.
The judge acknowledged that this case can be categorized as intimate partner violence.
Assistant Crown attorney Nicole Stortini agreed. "It is a very sad case of intimate partner violence," she said outside the courthouse. "The family is going through palpable grief, and they were very clear in expressing their grief."
Fellow assistant Crown attorney Jayme Lesperance pointed to the victim impact statements provided by Carling's family members. "(This murder) had a profound impact on children, cousins, siblings, and parents. We could never help with this wake of grief. We just hope this gives them some finality."
Espinoza Montes' status in Canada remains uncertain. He came to Essex County from the Honduras under a temporary foreign worker visa. But at the time of the murder, that visa had expired, and he was in the process of a refugee application.
The judge said he agrees with the Crown and the defence that immigration consequences should have no bearing on this sentencing.
Outside the courthouse, Lesperance said the Crown doesn't know if Esperanza Montes will be deported, and that will be matter for an immigration courts.
Justice Perfetto reserved his final comments for the victim's family in the Phillippines, who attended the courtroom virtually.
"It is difficult if not impossible for this court to console you," Perfetto told them. "There is nothing this court can do to undo the past... I wish that were different."
"However, I hope that as time passes, you will find healing and peace."

Driver to be sentenced in double fatal DWI crash into Park Tavern patio in St. Louis Park

The man who pleaded guilty to driving drunk into the patio of Park Tavern in St. Louis Park last year is scheduled to be sentenced Monday. Police say 56-year-old Steven Bailey plowed into the patio last September, killing restaurant employee and mother of three Kristina Folkerts and Methodist Hospital worker Gabe Harvey, both of whom were 30 years old. More than a dozen others were also hurt. Bailey, of St. Louis Park, first struck a parked vehicle while backing his BMW X5 into a spot in Park Tavern's lot. He then struck an oncoming SUV before accelerating up to 45 mph and smashing through the patio's metal fence, charging documents stated. Officers at the scene say they overheard Bailey tell someone in a phone call that he "hit the gas instead of the brake and went right through a thing," and, "I'm f***ed." Investigators said Bailey was intoxicated at four times the legal limit. His record shows five prior convictions for driving while intoxicated, with the first case in 1985 and the last case in 2014. In May, Bailey pleaded guilty to two counts of third-degree murder and three counts of criminal vehicular operation. Bailey is set to be sentenced Monday afternoon at 1 p.m. He faces up to 30 years in prison. Legislation was drafted in response to this crash. The proposal, which was signed into law earlier this year, lengthens the amount of time repeat DWI offenders would have to use ignition interlock devices — a breathalyzer that prevents an engine from starting if a person is intoxicated — to get behind the wheel. Lawmakers said if their proposed changes had been in effect at the time, Bailey would have had an ignition interlock on his vehicle based on his Cummings and Stephen Swanson contributed to this report.

5-Year-Old Girl Escapes Shooting Covering in Blood Splatter After Man Allegedly Kills 3 Women in Florida Home: Police

The shooting occurred at a residence in Nassau County, Fla. on the evening of Thursday, July 24 A 5-year-old girl managed to escape without being hurt after three females were shot and killed by a gunman in a home in Florida, authorities have said. On Thursday, July 24 at around 8 p.m. local time, the Nassau County Sheriff's Office responded to reports of a possible shooting on West 12th Avenue in Hilliard, Nassau County, Sheriff Bill Leeper said at a news conference, per a clip shared by First Coast News. Leeper told reporters the incident was "tragic," adding, "It's heartbreaking and totally, totally was unnecessary." He explained that "deputies [had] responded to the residence and attempted to make contact with anyone inside." 'We got no response. They tried to look through open windows to see if there were any signs of people inside. As they checked the front door, they found it to be unlocked, so they opened the door and announced who they were and called out for anyone, but got no response," Leeper said. Officers who entered the residence then saw a female "on the floor, between the living room and dining room, lying in blood," before noticing a male subject in the living room, with a black assault-style rifle beside him. Another female was discovered deceased in the hallway bathroom and a further deceased female was found in a bedroom across the hall from the bathroom. The male had a "slight pulse," and was airlifted to hospital, the sheriff told reporters. The male suspect — who has been identified as Christopher Bobby Rowell, 34 — is now clinically dead, the officer said. Leeper confirmed the gun found next to him was a black 'SKS-style 7.62 caliber assault rifle.' 'It appears the shooter first shot the female in the living room, dining room area, then shot the female in the bathroom, and then shot the female in the bedroom,' the sheriff told reporters. 'He eventually returned to the living room where he shot himself in the head.' Discussing the 5-year-old's escape, the sheriff said, "A neighbor across the street reported that a 5-year-old female, who was inside the residence at the time of the shooting, came to their house, banging on the door and stated the suspect had killed others inside the home," adding that they then called 911. "The child said she was in the back of the house, heard a gun shot, she came down the hallway, seen [the] female on the floor,' Leeper said at the conference. 'Another female grabbed her, put her in the bathroom." And when the woman who pulled the little girl into the bathroom was shot, Leeper said the 5-year-old "got blood splatter on her." The sheriff told reporters the little girl "was in shock, naturally,' following the incident. 'She's a very strong little girl. Very brave. Beautiful girl. She's with other relatives at this time. So she's safe, but she was traumatized," he said during the conference. Want to keep up with the latest crime coverage? All those involved in the shooting were related, the sheriff said, but he declined to mention how at the moment. He told reporters that this was "some type of domestic incident," and said further details would eventually be released amid the ongoing investigation. The Nassau County Sheriff's Office didn't immediately respond when contacted by PEOPLE for additional information. Read the original article on People
