Cofeposa invoked against Ranya,1-yr preventive detention likely

Time of India25-04-2025
Bengaluru: The Union govt has invoked the stringent anti-smuggling law -- Conservation of Foreign Exchange and Prevention of Smuggling Activities (Cofeposa) Act, 1974 -- against actor
Ranya Rao
, daughter of senior IPS officer Ramchandra Rao, in alleged gold-smuggling case. The Act, invoked by the Union finance ministry, provides for one-year
preventive detention
.
Rao, currently remanded in judicial custody and lodged in Bengaluru Central Prison, approached
Karnataka high court
seeking bail. Her bail petitions had been turned down by the special court for economic offences and the sessions court earlier.
P Prasanna Kumar, special public prosecutor for NIA and CBI, confirmed there is no provision for granting bail under Cofeposa. "The Act is brought against persons who are clandestinely involved in smuggling activities which are of serious magnitude and are organised in nature. The preventive detention under Cofeposa is invoked for effective prevention of smuggling activities which would adversely affect the national economy and thereby cause a serious effect on the security of the country," Kumar said.
He said Ranya will continue to remain in the existing judicial custody of Bengaluru Central Prison until the advisory board considers the case. If the advisory board upholds the order of preventive detention under Cofeposa, the detainee would remain in custody for a maximum period of one year.

"A detainee can be confined up to one year without any trial in the court of law as there is no option for applying bail under Cofeposa. The only remedy available to the detainee is to give representations to the detaining authority, the government and the advisory board. Only they have the power to consider such representation and release him/her. However, the detainee or family members can challenge the order of detention in high court or Supreme Court," said Aruna Shyam M, Senior advocate and former additional advocate general, Karnataka.

Collectors shall form panels to ensure resources meant for public use reach all: HC

District administrations, as part of their essential duties, should constitute committees in each village panchayat to ensure resources dedicated to public use are accessible to all without any discrimination on the basis of caste, the Madurai Bench of the Madras High Court has observed. Justice R.N. Manjula observed that the government had got a bounden duty to ensure the effective implementation of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Section 21 of the Act spoke about the duty of the government to ensure the effective implementation of the Act. Earlier, the court took a serious view of caste discrimination reported in Thalaivankottai in Tenkasi district, where Scheduled Caste people had to wait to collect their share of water from a public tap till the water needs of the other communities were fulfilled. The court had directed the Tenkasi Collector to take appropriate steps and ensure that such discrimination did not take place. Pursuant to the court order, the Tenkasi Collector, in a report, submitted that 17 public water tap connections had been provided and water was being supplied for three hours every day. It was also submitted that a committee comprising the panchayat president, panchayat secretary and Zonal Assistant Block Development Officer had been formed to ensure that there was no discrimination between people belonging to different communities. The court observed that Section 3(1)(za) (A) of the Act included obstruction and prevention of a member of a Scheduled Caste or a Scheduled Tribe from using a common public area or resources as an offence. The court directed the Directorates of Municipal Administration and Town Panchayats and the District Collectors, under the supervision of the Chief Secretary and with the coordination of the Director General of Police, to implement the objectives of Section 21 of the Act, especially in the matter of sharing water and file a report. A healthy atmosphere in rural and urban communities should be ensured in order to achieve the objective of the Act, the court observed and posted the matter for hearing to August 21.

'Can't comment on actions of EC': Centre cites 1988 ruling to reject Opposition demands for Bihar SIR debate

NEW DELHI: The Union government has signaled its unwillingness to allow a debate on the Special Intensive Revision (SIR) of electoral rolls in Bihar, with Rajya Sabha Deputy Chairman Harivansh invoking a 1988 ruling by former Lok Sabha Speaker Balram Jakhar to reject the Opposition's demand. On Tuesday, Harivansh cited Jakhar's December 1988 decision, which barred parliamentary discussion on the functioning or decisions of the Election Commission (EC), stating that the autonomous body's actions cannot be scrutinized in the House. 'You know that I cannot comment upon the actions and decisions of the EC, which is an autonomous body. Never before have I done it, nor will I do it now. Unless you amend the Constitution and bring the EC under parliamentary purview, we cannot discuss its decisions,' Harivansh said, quoting Jakhar's ruling. The Deputy Chairman's remarks came as he dismissed 34 notices submitted by Opposition MPs, most seeking the suspension of business under Rule 267 to urgently debate the SIR in Bihar and other states. Harivansh cited procedural flaws, including incorrect formatting, the sub judice nature of some matters, and the absence of precedent for such discussions. He expressed concern over the frequent misuse of Rule 267, meant for 'rarest of rare' cases, noting that most notices lacked proper citations or pertained to issues outside Parliament's jurisdiction. 'Despite clear rules, some members are using Rule 267 casually, disrupting proceedings when their notices are disallowed,' he said. Highlighting historical data, Harivansh pointed out that very few such notices had been accepted—none between 2000–2004, only four from 2004–2009, one out of 491 during 2009–2014, and just six out of 3,152 between 2014 and the 2025 Budget Session.

Go beyond politics to work towards improving city's infrastructure, urges Ashwini Vaishnaw

Going beyond politics, Karnataka and the Union government should work together to improve Bengaluru's infrastructure, urged Ashwini Vaishnaw, Minister for Railways, Information and Broadcasting and Electronics & Information Technology. He was delivering a virtual keynote address at the opening of SAP Labs' largest campus in India at Devanahalli here on Tuesday. He said the Union government was committed to working with the State government, despite political differences, to improve the infrastructure condition of the city. Rail connectivity The Minister further said that the government was keen to improve the transportation facility within the city and outside the city. 'We are planning to double the rail connectivity within the city and to the city from outside in the next three years,' he said. Earlier, inaugurating SAP Labs India Innovation Park, on 41 acres of land at Devanahalli, Chief Minister Siddaramaiah said, 'Both Airport Metro line and suburban rail were being fast tracked to be ready by 2029. He said he was committed to balancing, decentralising, and sustainable growth beyond the core of Bengaluru.' He said that his government was happy to partner with SAP Labs in areas like digital governance, smart cities, skilling, and sustainability to empower MSMEs, and enhance government services in the State. The new SAP facility represented the global enterprise's deep trust in Karnataka's capability, the Chief Minister said. Since 1998, SAP Labs India, headquartered in Bengaluru, has grown to become SAP's largest R&D facility outside Germany. 'As we advance in clean energy, sustainable mobility, and eco-conscious growth, investments like this demonstrate how economic progress and environmental responsibility can go hand in hand,' Mr. Siddaramaiah said. On education and skill development, he said, with an ambitious ₹2,500-crore programme supported by the World Bank, his government was strengthening first-grade colleges, establishing a Centre of Excellence, and enhancing R&D capabilities to build a skilled, future-ready workforce aligned with the demands of advanced technologies. Sindhu Gangadharan, managing director, SAP Labs India and head of customer innovation services, SAP said, 'India's rise as a global technology powerhouse is not just a story of scale — it's a story of ingenuity, resilience, and relentless innovation.' Thomas Saueressig, member of the executive board of SAP SE for Customer Services and Delivery said, 'It is a global innovation hub that will help our customers move from insight to action with enterprise-grade AI, data, and applications created right here in India.' Addressing the gathering Philipp Ackermann, German Ambassador to India, said, 'When SAP entered India in 1998, the country was future for the company and now, India a huge market for SAP.'
