Vietnamese tycoon escpaes death sentence over $27bn fraud case

A Vietnamese property tycoon sentenced to death for fraud totalling $27 billion will no longer face execution, her lawyer said Wednesday, as the country abolished capital punishment for eight crimes, including property embezzlement.
Property developer Truong My Lan's lawyer Giang Hong Thanh told AFP that her death penalty 'will be converted to life imprisonment… I informed Ms. Lan this morning, she is very happy.'
Vietnam on Wednesday abolished the death penalty for eight crimes including espionage, graft and attempting to overthrow the government, according to state media.
Lan, 68, was convicted last year of swindling money from Saigon Commercial Bank (SCB) – which prosecutors said she controlled – and sentenced to death for fraud with damages totalling $27 billion – equivalent to around six percent of the country's GDP.

She appealed the verdict in a month-long trial, but in December the court in Ho Chi Minh City determined that there was 'no basis' to reduce her sentence.
But the court said Lan's sentence could be reduced to life imprisonment if she returned three quarters of the stolen assets.
'If Ms Lan compensates for three quarters of the losses along with some other conditions, she will continue to be considered for a further reduction of her sentence,' lawyer Thanh said Wednesday.
Lan 'is still actively cooperating with state agencies of Vietnam and her partners to find ways to deal with (her) assets and restructure SCB to come to a final solution to the case.'
Lan owned just five percent of shares in SCB on paper but courts concluded that she effectively controlled more than 90 percent through family, friends and staff.
Tens of thousands of people who had invested their savings in the bank lost money, prompting rare protests in the communist nation.
In a separate $17 billion money-laundering case, Lan had a life imprisonment sentence cut to 30 years on appeal in April.

According to the amended penal code approved by the National Assembly Wednesday, the eight crimes no longer punishable by death include property embezzlement and bribe-taking.
Under Vietnamese law, those sentenced to death for the eight crimes – which also include spying and anti-state activities – before July 1 will have their sentences converted to life imprisonment by the chief judge of the Suprem People's Court.
Minister of Public Security Luong Tam Quang said 'the current structure of capital punishment was problematic and, in some cases, misaligned with evolving socio-economic conditions and the realities of crime prevention.'
One of the reasons for the move given by Minister of Justice Nguyen Hai Ninh was that in most cases people sentenced to death for the above crimes were not actually executed.
The number of executions has not been made public, but Amnesty International estimates more than 1,200 people were on death row in Vietnam by the end of 2024.

India and Ghana agreed on Wednesday to ramp up cooperation in defence, food security and pharmaceuticals and to double two-way trade to $6 billion in five years. 'In these times of global uncertainty, India's democratic stability shines as a ray of hope. India's rapid progress is a catalyst for global growth. As the world's largest democracy, India is a pillar of strength for the world. A strong India will contribute to a more stable and prosperous world,' Modi said in a rare speech in English. A technological revolution, rise of the Global South and shifting demographics are contributing to rapid changes in the global order created after World War II, and the world is facing complex crises such as climate change, pandemics, terrorism and cybersecurity. 'Institutions created in the last century are struggling to respond. The changing circumstances demand credible and effective reforms in global governance,' he said. Modi emphasised progress isn't possible without giving voice to the Global South. 'We need more than slogans. We need action… We put emphasis on Africa's rightful place at the global high table,' he told a gathering that included Ghanaian President John Dramani Mahama, vice president Naana Jane Opoku-Agyemang, Speaker Alban Bagbin, MPs, representatives of political parties, diplomats and members of the Indian community. India, with its fast growing economy, stable polity and role as an innovation and technology hub, can help drive the progress of African nations. 'Africa's goals are our priorities. Our approach is to grow together as equals. Our development partnership with Africa is demand-driven,' Modi said. 'It is focussed on building local capacities and creating local opportunities. Our objective is not just to invest, but to empower… We have expanded our diplomatic presence to 46 countries across Africa. Over 200 projects across the continent enhance connectivity, infrastructure and industrial capacity,' he said. Welcoming Ghana's efforts to accelerate economic integration under the African Continental Free Trade Area, Modi pointed to the country's potential to become a regional IT and innovation hub. Modi quoted from both former Ghanaian president Francis Kwame Nkrumah and the Rig Veda to emphasise the shared democratic ideals of the two countries. Recalling Nkrumah's remarks that 'The forces that unite us are intrinsic and greater than the superimposed influences that keep us apart', he said that true democracy promotes discussion and debate, unites people and promotes human rights. The Rig Veda, he said, states 'let good thoughts come to us from all directions' and this openness to ideas is the core of democracy. 'This is also the reason that people who came to India have always been welcomed with open hearts. The same spirit helps Indians integrate easily wherever they go,' he added. Following the address, Modi interacted with Ghanaian MPs. Earlier, he paid tribute to Nkrumah at a memorial dedicated to the Ghanaian leader. Even as the unit is said to have been engaged in such attacks, it has performed poorly on the battlefield and has been repeatedly routed and devastated, requiring multiple rounds of replenishment and redeployment throughout the war after every round of defeat. Even though the unit was counted among the elites of the Russian military before the war, its reputation is now in tatters as it has been involved in some of the lowest moments of the war in Bucha, Irpin, Pavlivka, and Vuhledar, according to Business Insider. 'They've gotten their asses handed to them again and again and again,' William Alberque of the International Institute for Strategic Studies told Insider. Despite such a record, a Russian governor heaped praises on Gudkov after death. Oleg Kozhemyako, the head of Russia's Primorye region in far east, said Gudkov 'was killed carrying out his duty as an officer', according to AFP.
