
Hawks, NPA explain why corruption investigations, prosecutions take long

The Hawks and the National Prosecuting Authority (NPA) have explained the delays in investigating and prosecuting corruption cases to Parliament, citing challenges such as limited resources and complex legal processes.
On Wednesday, officials from the NPA and the Directorate for Priority Crime Investigation (DPCI) appeared before the Standing Committee on Public Accounts (Scopa).
They provided an update on corruption cases referred by the Special Investigating Unit (SIU).
SIU referrals to Hawks
During the meeting, SIU head Andy Mothibi clarified that the unit refers matters to the NPA only when it believes that the evidence suggests criminal conduct.
'Whether it meets the criminal standard or not is for the NPA to decide,' he said.
Mothibi noted that 3 374 referrals had been made over a five-year period between April 2020 and May of this year.
These referrals often involve multiple individuals or companies.
Mmeli Makinyane, component head of the Hawks' serious commercial crime, indicated that the DPCI had processed 355 dockets originating from SIU referrals.

He stated that 58 of these cases are currently before the courts, 96 dockets are awaiting a decision from the NPA, and 201 are still under investigation.
According to Makinyane, 72 cases have resulted in guilty verdicts, while one ended in acquittal.
The NPA declined to prosecute 15 cases due to either insufficient evidence or poor prospects of success.
Makinyane further explained that these cases involved various government departments and state-owned entities, including Denel, Eskom, and several municipalities.

Many of the cases are tied to allegations of fraud, theft, corruption, and related offences.
A significant number of the referrals came from the Department of Higher Education and related to fraudulent applications to the National Student Financial Aid Scheme (Nsfas).
He added that four cases linked to state capture had been investigated, one of which led to a conviction.
In relation to Covid-19, the Hawks received 93 referrals from the SIU.
Of these, 22 are now in court, 12 have been submitted to the NPA, and 59 are still under active investigation.
Skills gaps continue to hamper Hawks investigations
Makinyane conceded that the Hawks had to outsource certain skills to handle complex investigations due to internal capacity constraints.
'The issue of resources always comes and hits us hard when we get to the time that we take in finalising our matters,' he told MPs.
Patrick Mbotho, Hawks' divisional commissioner for national priority offences, pointed out that the DPCI's forensic accounting capacity is 'very limited' and that the recruitment of the required skills is often slow.
'Our procurement is not the fastest,' he said.
He also mentioned that delays in declassifying documents posed additional hurdles.
'These are the kind of challenges that we sometimes face.'
NPA faces constraints in prosecution processes
National Director of Public Prosecutions (NDPP) Shamila Batohi addressed the limitations faced by the NPA once it receives cases.
She informed the committee that most matters are referred to the Hawks for further investigation, as the Investigating Directorate Against Corruption (IDAC) lacks the necessary capacity.
'IDAC is a very small part of the work in any event. There's still a large number that goes to the DPCI,' she said.
Batohi stressed the difference between criminal and civil standards of proof.
'There are still investigations that need to be done in order to meet the criminal standard so that we can make the decision to prosecute.'

She also revealed that a digital evidence unit had been established within IDAC to improve analysis of electronic evidence.
'The capacity is still small, but this is potentially something that is a game changer,' she said.
Batohi emphasised that digital devices like phones and laptops are now critical sources of evidence and require rare, expensive skills that have been 'delaying a lot of these cases'.
She clarified that while Directors of Public Prosecutions (DPPs) in each province are authorised to make decisions on prosecutions, the NDPP only intervenes in specific cases.
'An NDPP is a review mechanism that can review decisions of DPPs in various circumstances.'
NPA explains delays in cases
IDAC's chief director of investigation and information management, Matthews Sesoko, told MPs that the nature of the investigations contributes to the delays.
He further highlighted that since the unit's establishment in August last year, recruitment efforts had struggled to attract individuals with the necessary skills.
'That on its own takes time for us to be properly capacitated to move quicker with our investigations.'
Sesoko said many of the cases under investigation involve Eskom and Transnet contracts.
Some of these cases are already in court, but others have been pending for extended periods due to the number of accused.

'The accused persons will lodge interlocutory applications which we will have to respond to and that itself lengthens the cases.
'The accused persons will also, from time to time, change legal representations and that also delays matters moving forward.'
Nkebe Kanyane, Special Director of Public Prosecutions from the Special Commercial Crime Unit, explained that most of the postponements were not caused by the state.
'There were cases where of course the docket was not in court so that is the state's fault,' she remarked.
Kanyane revealed that the NPA had collected nationwide court data to determine reasons for delays.
Infrastructure issues such as load shedding and water shortages, along with the unavailability of prosecutors, presiding officers, defence counsel, or the accused, were among the reasons identified.
She added that there were 74 cases in which the NPA had declined to prosecute.
Civil recovery
Batohi spoke about the value of civil recovery through the Asset Forfeiture Unit, describing it as an effective tool in the fight against corruption.
She clarified that civil recovery allowed the state to reclaim funds without needing a criminal conviction, particularly when companies disclose their involvement and cooperate with investigators.
'Individual persons are still subject to prosecution, but the benefit of the resolution is that the corporate agrees to actually work with the investigators to provide evidence against individuals.'
Batohi also raised concerns about witness protection, which she identified as a key barrier to successful prosecutions.
'People coming forward to speak out against corruption put their lives at stake,' she said.
She acknowledged the NPA's difficulties in retaining skilled professionals, citing competition from the SIU and South African Revenue Service.

"The NPA is of the firm view that the Honourable judge erred in dismissing the application for leave to appeal, and that there are reasonable prospects of success to appeal the Cholota judgment, and that there are compelling reasons for the SCA to hear our appeal. "We are also exploring the possibility of approaching the Constitutional Court, challenging the same judgment, given the possible far-reaching implications on many other extradition matters," said Mhaga. It is important to note that during the previous trial within a trial concerning the jurisdiction issue, the merits of the state's case against Cholota were neither adjudicated nor formally assessed. This withdrawal from a full examination has led the NPA to maintain that the charges she faces remain viable and can be substantiated in a subsequent trial. MK Party claims selective prosecution, stands by Molefe and Gama

Image: file The uMkhonto weSizwe Party (MK Party) has come out in strong support of its senior members and MPs, Brian Molefe and Siyabonga Gama, who are facing charges related to a multi-billion rand scandal involving the procurement of locomotives at Transnet. The party's national spokesperson, Nhlamulo Ndhlela, questioned the National Prosecuting Authority's (NPA) impartiality, accusing the justice system of engaging in a "troubling pattern of retaliation" against party members who have held state institutions to account. Molefe, Gama, and two other former Transnet executives, Anoj Singh and Thamsanqa Jiyane, were arrested and released on bail of R50,000 each on Monday. Ndhlela said the party would not be silenced or intimidated by the charges against its members. "The continued attacks on their character and professional integrity are not isolated incidents: they are part of a systemic purge targeting those who dare to challenge the status quo," he said. The MK Party has consistently called for accountability within state-owned enterprises and institutions like the NPA, which must be held to the highest standards of integrity. However, Ndhlela claims that when the party raises legitimate questions about institutional bias and political capture, the response is swift and punitive. "We reject the notion that these arrests are rooted in a genuine pursuit of justice. Instead, they are part of a broader, deeply troubling campaign that seeks to intimidate and criminalize black professionals, intellectuals, and revolutionaries, particularly those associated with the MK Party," Ndhlela said. 'It is increasingly evident that when the MK Party challenges institutions captured or influenced by narrow political interests, our members become targets,' he said. Ndhlela further said the two members would continue to be the party's MP's until further notice. 'These charges reek of nothing else, but you know, a political agenda. So, we're not going to now, all of a sudden, purge our people and our members on the basis of, you know, cases or should we say charges that are brought to them on the basis of, you know, something that transpired when there was the Transnet and so on so forth. So, let's await the court process to unfold and we said we respect the rule of law. Let's allow the process to unfold and we take it from there,' Ndhlela reportedly said. Molefe, Gama, Singh and Jiyane, face 32 charges, including fraud, corruption, and violations of the Public Finance Management Act and the Companies Act. According to the charge sheet, the four executives allegedly conspired to favor the Chinese Rail Corporation (CRC) in the procurement of locomotives, resulting in inflated costs of at least R18 billion. The four executives are set to face trial in October 2025. If convicted, they could face significant penalties, including imprisonment and fines. The trial will determine whether the four executives are guilty of the charges against them, which include dereliction of corporate and constitutional duty, fraud, and corruption. Molefe faces 10 charges, Gama six charges, and Jiyane three charges, while Singh faces 13 charges. They are all accused of benefiting from bribes during their tenure as Transnet officials.

Political violence in KwaZulu-Natal: Why Moerane Commission recommendations remain unimplemented

Image: Bongani Hans The recommendations of the Moerane Commission, which investigated the spate of political killings in KwaZulu-Natal, are gathering dust without being implemented seven years after they were released, while the killings continued unabated. Former premier Willies Mchunu said one of the recommendations was the establishment of an independent panel, which was to forge peace within and among political parties. Mchunu established the Advocate Marumo Moerane SC-led commission in October 2016 during the peak of political killings, which at the time exceeded 150, to identify their root cause and how they could be eliminated. He said Moerane suggested that the panel should help politicians, who would normally kill each other for tenders and positions. However, the establishment of the panel would require funding. Mchunu, who was the premier between 2016 and 2019, said he could not establish this panel because his term of office was running out. The issue of political killings after the commission's recommendation was topical at the Pietermaritzburg High Court on Monday when the NPA and defence lawyers debated it during Sibusiso Ncengwa's mitigation of sentence. Ncengwa will be sentenced next Monday after he confessed to the killing of the former ANC Youth League secretary-general, Sindiso Magaqa, who was an ANC councillor at the Mzimkhulu Municipality when he was gunned down in 2017. In his affidavit, Ncengwa confessed that he and his fellow hitmen were hired by the former mayor of the Mzimkhulu Municipality, Mluleki Ndobe, who was also ANC's Harry Gwala Region chairperson, and other senior officials, including a municipal manager, to eliminate Magaqa. Magaqa's sin was that he was about to spill the beans on the corrupt-riddled tender to build a local memorial hall. He was executed in broad daylight at a car wash on July 13, 2017. Other councillors who were with him survived with bullet wounds. The assassins were paid a total of R620,000 and also promised a R1 million tender. The State and the defence had agreed to a jail sentence of less than life on condition that Ncengwa would soon testify against the people his affidavit implicated. Ndobe committed suicide on November 6, 2020, while the assassin, Jabulani Mdunge, who allegedly shot Magaqa with an AK-47 obtained from a crime intelligence officer, was later killed in a shootout with police. Mchunu said the political killings in the province would not end as long as there are political parties' elective conferences, and general, local government, and by-elections, because politicians were greedy for power and material benefits. 'For those things (power and benefits), they will continue to fight one another to the extent of even killing one another. 'That is why there should be an independent programme to teach those who are participants in politics about how to conduct themselves civilly.' Mchunu said the provincial government should consult Moerane and the African Centre for the Constructive Resolution of Disputes (ACCORD) for advice on how to establish the peace-making body. During the court proceeding on Monday, NPA's Advocate Elvis Gcweku and Ncengwa's advocate, Andrew Matlamela, spoke about the political killings continuing after the Moerane Commission. People who testified at the commission about Magaqa's murder were lined up as witnesses in the murder trial. 'When I perused the commission's report, there was an opening quotation that says, 'something is rotten in the state of Denmark'. 'That commission was clearly describing the state of KwaZulu-Natal in respect of the political killings,' said Ngcweku. He said the commission concluded that Magaqa's killing was linked to the corruption in Mzimkhulu Municipality, whose hall's construction took a long time than expected to be completed, while money had already been spent. Magaqa demanded progress in the construction and also proposed forensic investigations, and that the matter be debated at the council. 'What is common about the killing of politicians in KwaZulu-Natal is the issue of tenders and corruption within the municipalities,' said Ngcweku. He cited the killing of Sduduzo Magwaza, an ANC chairperson in Ward 102, north of Durban, as an example that, after Moerane had concluded his work, killings continued. Magwaza's murder in November 2021 was also connected to tenders. 'Similarities between this case (Magaqa) and that case (Magwaza) are that the comrades kill other comrades using hitmen,' Ngcweku said. Matlamela said the ANC was rotten when it came to political killings, which the party has refuted.
