Data breach ‘distress' case does not need personal injuries board approval, Supreme Court rules
A man who claims he suffered from distress, upset and anxiety arising from a financial services company's disclosure of his personal data to a third party may bring a case for damages without Personal Injuries Assessment Board (PIAB) approval, the Supreme Court has ruled. The court's ruling clarifies that claims for damages for 'emotional disturbances' which fall short of a recognised psychiatric disorder are not 'personal injury' claims, as defined by the Personal Injuries Assessment Board Act 2003. Before his appeal to the Supreme Court, Patrick Dillon's case seeking damages against Irish Life Assurance plc arising from a data breach was dismissed by the Circuit Court and High Court. The breach complained of occurred when Irish Life erroneously shared letters containing Mr Dillion's personal and financial data with a third party. Both the Circuit Court and High Court ruled Mr Dillon's case sought damages for 'personal injury', and in circumstances where Mr Dillion did not obtain PIAB authorisation before bringing the proceedings, the case should be dismissed as being frivolous, vexatious or bound to fail. READ MORE Under the Personal Injuries Assessment Board Act 2003, a party proposing to bring a case seeking damages for 'personal injury' must obtain authorisation from the PIAB. Mr Dillon's appeal to the Supreme Court was rooted in the question of whether a claim for damages for distress, upset and anxiety falls under the definition of 'personal injury' in the Personal Injuries Assessment Board Act 2003. The Act defines personal injury as including 'any disease and any impairment of a person's physical or mental condition'. In a judgment on Thursday, Mr Justice Brian Murray, on behalf of a five-judge Supreme Court panel, ruled that claims for damages for 'emotional disturbances' like distress, upset, anxiety and inconvenience which fall short of a recognised psychiatric disorder – like Mr Dillon's – is not a personal injury claim, as defined by the Act. As such, the judge found the Circuit Court and High Court were wrong to dismiss Mr Dillon's case on the basis that he had not obtained PIAB authorisation. This Act allows for judicial remedy, including compensation, for infringement of a data subject's rights. Mr Justice Murray noted that those who bring claims solely for mental distress, anxiety and upset – which do not require PIAB authorisation – 'cannot expect anything other than very, very modest awards'. The judge said it would be possible for a plaintiff to bring a case alleging a breach of their rights under the Data Protection Act 2018 that gives rise to a medically recognised psychiatric injury. In those circumstances, PIAB authorisation would be required to bring the case.

100% I.D. scan begins June 1 on Fort Benning
FORT BENNING () — June 1st, gates on Fort Benning will no longer have self-scan lanes as the military installation will enforce the 100% I.D. scan. 'It means that every single person who is coming through an access control point. We will be able to positively identify them,' says Fort Benning Access Control Chief Matthew Dillion. Dillion tells WRBL this differs from the Trusted Traveler Program. He says, 'a Trusted Traveler could come through, scan their I.D. and they were vouching for the people that were in their vehicle. Now when they come through, they're still the trusted traveler. There's no change to that. The only difference is where a trusted traveler used to vouch for everybody. Now we're at 100% I.D. and everybody.' The 100% scan is usually implemented only at night Dillion says. Starting Sunday, Fort Benning's Commander Major General Colin Tooley will require 100% I.D. checks at all gates 24/7. Dillion says, there are other ways to get on the army post without scanning your I.D. at the gate. 'The first way is to go to a visitor control center,' Dillion explains. 'We're one of the few installations that has one that's open 24 hours… On the other side, you can go online. We have an online system where you can actually process for a pass specifically to their event.' Dillion says these processes allow for security to conduct background checks on every person coming in. Wednesday through Fridays Fort Benning see's higher levels of traffic due to family days and graduations Dillion says. Prior to getting to the access gate, Dillion encourages having your ID ready for a quick and smooth entry onto the military post. He says people who have been previously denied or barred, have active warrants and other things of that nature will be denied access. For those who have yet to get their Real I.D., Dillion says additional documentation may be needed to gain access. He says this can be handled in the lane or be sent to the visitor control center. 'I Remember Mama' campaign seeks to celebrate all for Mother's Day
ROCHESTER, N.Y. (WROC) — Easter is behind us, and next up is Mother's Day. A local organization asks you to help them make sure no mom is forgotten. Volunteers of America has an annual campaign called 'I Remember Mama' now running for more than 35 years. The Upstate New York chapter is right now accepting donations to share flowers, gifts, and thoughtful cards with local moms who may have no one to honor them. The president and CEO stopped by the News 8 at Sunrise studio explaining that women so often spend all their lives caring for others, so this is a chance to repay their love and hard work. 'We know that there's many women in our community that won't feel so special, because maybe the people in their lives are not here to acknowledge them—whether it's because they've been separated from some of those that love them or they've just outlived them. So we want to make sure they feel acknowledged and show them how important they are,' explains Dr. Junior Dillion. The VOA hopes to make at least 200 gift packages this year for the women in the program's low-income housing as well as across the Greater Rochester region.
