Labour Court rejects George Municipality's bid to validate unqualified HR appointment

A former employee of the George Municipality was appointed as an HR manager under circumstances which amounted to an unfair labour practice as the person did not have the minimum qualification requirement.

The George Municipality's Labour Court bid to have a now-retired employee's appointment declared lawful has been dismissed, with the court upholding that the appointment flouted fair labour practice.
The municipality appointed the woman as a Human Resources manager in 2015 without having the minimum qualification requirement.
A commissioner of the South African Local Government Bargaining Council found the municipality committed an unfair labour practice in shortlisting and appointing the woman without the NQF Level 7 qualification.
This prejudiced two other employees who applied for the same position and held the required qualification but ranked lower in the interviewing process.
The employee has since retired.
The municipality sought the arbitration sanction to be reviewed and set aside, and for it to be heard afresh before a new commissioner.
It was in 2019, during an audit of the municipality's Human Resources Department, that the two employees who held the qualification became aware that their now-former colleague did not have an NQF level 7 qualification when she was appointed, as she was missing one subject for her qualification.
Acting Judge of the Labour Court, Glen Cassells, noted in his judgment that no condition was stipulated in the woman's appointment letter that she was required to obtain the qualification within a reasonable time.
The arbitration award noted that the municipality, as a local authority, is expected to comply with the requirements stated in the advertisement and that if the provisions existed to accommodate a candidate who otherwise did not meet the minimum requirements of the advertisement, this should be recorded in all relevant documentation.
'The arbitration award notes that (the former) employee had a national diploma in library and information services and that her highest incomplete qualification related to post school education, and that accordingly it would have been reasonable to frown upon choosing her, as the qualification stipulated in the advertisement was relevant to the position and deviating from it to accommodate a qualification not close to the position was problematic.
'The arbitrator concluded that the shortlisting committee and the Municipal Manager would have acted differently if they knew that she did not possess the minimum qualification… In the circumstances, she should not have been shortlisted and accordingly not appointed into the advertised position, and by allowing her to be part of the process and to be appointed under the circumstances amounted to an unfair labour practice as it was based upon a wrong principle,' said Cassells.

Vision 2025 recognised the transformative potential of green hydrogen in powering inclusive industrial growth, supporting decarbonisation, and promoting sustainability. These programmes are the first of their kind in the country, developed to equip learners with critical technical and operational skills needed in the green hydrogen value chain from production and storage to transportation and technology innovation. On 30 April 2025, the QCTO formally approved three new National Qualifications Framework (NQF): Level 4 programmes: The Chemical Industries Education and Training Authority (CHIETA) is proud to announce the approval of South Africa's first-ever green hydrogen skills programmes by the Quality Council for Trades and Occupations (QCTO). This marks a major leap forward in building the country's capacity for a sustainable and inclusive energy future. CEO of CHIETA, Yershen Pillay said the green hydrogen economy is not a distant dream, it is unfolding now 'Vision 2025 marked a turning point for CHIETA as we committed to leading skills development for the emerging green economy. This wasn't just about creating Qualifications, it was about future-proofing our workforce and ensuring no one is left behind in the energy transition,' said CHIETA CEO, Yershen Pillay. Following the strategic direction outlined in Vision 2025, CHIETA initiated the development of these programmes in close collaboration with industry leaders, training providers, technical experts, and government stakeholders. The result: three nationally recognised qualifications designed to meet the real demands of a fast-evolving green hydrogen sector. Why Green Hydrogen? Why Now? Green hydrogen produced through the electrolysis of water using renewable energy has emerged globally as a game-changing clean energy source. In South Africa, it is seen as a catalyst for industrial growth, export potential, and decarbonisation. South Africa's rich renewable energy resources and strong chemical industry base place it in a unique position to lead the continent's green hydrogen revolution. However, without the right skills in place, this opportunity could be lost. 'These programmes ensure we don't just talk about a just energy transition, we deliver it. We're building the technical pipeline needed to support a green economy, while opening up career opportunities for youth, artisans, and operators across multiple industries,' said Pillay. The three QCTO-approved qualifications will prepare learners for a range of roles in green hydrogen production, storage, transport, and technology. Learners will be equipped to: Operate and maintain hydrogen production and storage equipment Coordinate technical activities and logistics Monitor environmental impacts and performance of hydrogen technologies Understand safety, regulatory, and industry standards Graduates will be ready for roles such as operators, artisans, maintenance technicians, and logistics professional across energy, transport, manufacturing, and chemical sectors. With QCTO approval secured, Skills Development Providers (SDPs) can now apply for programme accreditation. Once accredited, SDPs can begin offering the programmes, with CHIETA providing strategic guidance and support. CHIETA is also embarking on a national awareness campaign to promote uptake, build training infrastructure, and ensure access across provinces. The goal: create a strong, inclusive workforce ready to support South Africa's green hydrogen ambitions. The green hydrogen economy is not a distant dream it is unfolding now. These CHIETA-led programmes represent a decisive step toward a cleaner, more equitable energy future, rooted in skills development, sector transformation, and national progress.

Transnet plays a central role in the South African economy and the government's goal of inclusive growth. 'From supply chain analytics and IT systems integration to customer experience and compliance, logistics is evolving into a dynamic, tech-enabled industry that offers diverse professional avenues for South Africa's youth,' said Gregory Saffy, managing director for Sub-Saharan African Operations at FedEx. While traditional roles like drivers, packers and sorters will always be essential, they are increasingly supported by technology-driven processes. This shift creates additional opportunities for young people looking for more technology focused roles. 'Logistics isn't what it used to be. The real competitive advantage now lies in digital capability, especially in areas like data analytics and systems thinking. We're seeing more engineers and analysts in the business than ever before, guiding operations and enabling automation at scale,' said Saffy. Beyond data analytics and IT roles, compliance and customs clearance are also emerging as key growth areas for job creation. Saffy highlights the development of a formalised customs qualification as a major step forward for the industry. 'We're seeing progress in the creation of a national customs clearance certification that will give individuals a recognised qualification, including those with practical experience but no matric pass. This will create a clear career path and raise the overall standard of compliance across the industry,' he added. FedEx is already enrolling its customs clerks into newly developed courses in freight forwarding and customs compliance. In addition to formalising technical knowledge, these programmes also focus on future-ready skills like digital literacy, data analysis and critical thinking. For young people without access to formal education, FedEx offers a clear entry point through its Yes Learnerships. 'Our 12-month programme combines training, mentoring and practical work experience,' said Saffy. 'Since 2019, we've onboarded more than 150 unemployed youth through YES, with more than 60 going on to become permanent employees. It's a powerful model for bridging the gap between education and employment.' In parallel, FedEx runs a dedicated learnership programme for youth living with disabilities, offering an NQF Level 4 certificate in business administration. This includes coaching, blended learning and real-world operational experience – helping to build inclusive, work-ready skills pipelines. FedEx commitment to building inclusive talent pipelines is a powerful example of how private sector investment in skills development can help unlock opportunities and start turning the tide on youth unemployment. 'Logistics is a gateway to global trade. It's no longer just about moving parcels; it's about managing complexity in a fast-paced, tech-driven environment. With the right support and training, South Africa's youth can thrive in this space,' Saffy concluded.
