Constable did not get NOC to marry Pakistani woman, CRPF tells J&K HC
Munir Ahmed, a constable in the Central Reserve Police Force who was dismissed from service in May for allegedly 'concealing his marriage to a Pakistani national', had not been granted a no-objection certificate (NOC) for the wedding to go ahead, the CRPF told the Jammu and Kashmir and Ladakh High Court. The CRPF argued that Mr. Ahmed could not defend his actions by relying on sevice rules framed six decades ago, at a time when 'Pakistan was not a hostile country'. Mr. Ahmed had challenged his dismissal in the court, stating that, in accordance with the Central Civil Services Conduct Rules, 1964, he had informed the CRPF authorities of his marriage to his relative, a resident of Sialkot in Pakistan. The Rules say that a 'Government servant who has married or marries a person other than of Indian Nationality shall forthwith intimate the fact to the Government.' Also Read | Have married Pak woman only after getting nod from CRPF headquarters: Dismissed trooper Changing situation Mr. Ahmed's counsel Ankur Sharma said that he had filed a writ petition on May 23, challenging the dismissal on the grounds that CCS Rules merely require a government official to inform the government about marriage to a foreigner. On July 29, however, the CRPF urged the court to dismiss Mr. Ahmed's petition. It informed the court that in an internal communication on July 23, 2024, the CRPF had decided not to grant an NOC to the petitioner as the CCS Conduct Rules were 'framed 60 years ago and at that time Pakistan was not a hostile country.' 'However, after eruption of militancy in J&K, the neighboring country has become a hostile nation and is abetting terrorism in J&K which has claimed thousands of innocent lives. Besides terrorism, Pakistan is also finding various means and effort to gather intelligence of our strategic locations, camps, deployment and our weaponry and keeps our forces in proxy war,' the CRPF said. Also Read | Newly-wed CRPF jawan's wife among women on J&K repatriation list 'Could endanger national security' The CRPF said that Mr. Ahmed, who was employed as executive staff, had access to confidential information, including details about the deployment, camp security, and arms and ammunition of whichever company or battalion in which he served. 'Therefore, there is apprehension that once he gets married to a Pakistani girl our security will get compromised and which could endanger our national security. Moreover, this department is not knowing the credentials of the girl to whom he is going to marry. Some instances of women working as spies lure such boys into marriage even though in this case he states, she is a relative,' the CRPF said, arguing that it could be a case of a 'honeytrap.' Mr. Ahmed's wife Minal Khan was among the list of Pakistani nationals who were asked to leave India by April 27 in the aftermath of the April 22 Pahalgam terror attack where 26 civilians were killed. The J&K HC had stayed her deportation, minutes before she was to be sent to Pakistan via the Attari checkpoint in Punjab on April 27. Also Read | Married a cousin from Pakistan, kept department in loop, says dismissed CRPF jawan Long wait for NOC In September 2022, five years after joining the CRPF, Mr. Ahmed applied for an NOC to solemnise his marriage with Ms. Khan. His application was returned by CRPF due to incomplete details in January 2023. He again submitted an application in October 2023, seeking an NOC for the proposed wedding on November 5, 2023. His application stated that Ms. Khan had applied for a visa before the Indian High Commission in Pakistan, for which the NOC was required. When the permission did not arrive, the constable married her online on May 24, 2024. The CRPF said that though Mr. Ahmed had contracted the marriage, or nikah, with Ms. Khan in May 2024, he had informed the department only four months later, on October 14, 2024, when he was asked about it by his senior colleague. His wife came to India this year on a short term visa which expired on March 22, and then 'continued to stay in India illegally', the CRPF said. 'It is also clear that Constable Munir Ahmed actively supported her stay at his own residence in the Border state of J&K. He further provided shelter and harboured a Pakistani national while being aware of status of her Visa,' it added.
