Tihar Jail Prisoner Dies By Suicide

A prisoner in Tihar Jail's hospital died by suicide by hanging himself from a window, informed the Tihar Jail officials in the early hours of Monday.
The prisoner was an under-trial inmate, namely Ramesh Karmakar, who was lodged in Jail Number 4 but was undergoing treatment at the jail hospital in Jail Number 3 since May 28.
Karmakar's body was found hanging from a window late on the night of Sunday, and the jail authorities were informed on the early morning of Monday.
In another such case, an accused named Saquib Nachan in connection with the terror group Islamic State (ISIS), died in Delhi's Safdarjung Hospital, informed sources said on Saturday.
He has been in judicial custody in Tihar Jail since 2023 and was admitted to the hospital a few days ago, they said.
Saquib was convicted for his involvement in the bomb blasts in Mumbai in 2002 and 2003.
In line with the National Investigation Agency (NIA), Saquib Nachan, a habitual offender in many previous terror cases, was also a self-styled Amir-e-Hind for ISIS in India.
Earlier in June 2024, the National Investigative Agency (NIA) had chargesheeted Nachan along with 16 hardcore agents of a proscribed global terrorist network, in a conspiracy involving the recruitment and radicalisation of youth and the fabrication of improvised explosive devices in the Delhi-Padgha ISIS terror module case.
The accused were chargesheeted under various sections of IPC, UA(P) Act, Arms Act and Explosive Substances ACt, were found to have been engaged in a massive ISISI conspirancy involving recruitment, training and propagation of Islamic State of Iraq and Syria (ISIS) ideology among gullible youth, along with fabrication of explosives and IEDs are fund-raising for the banned outfit.
Its investigation had subsequently led to the seizure of several incriminating documents and data relating to the manufacturing of explosives and the fabrication of IEDs, along with propaganda magazines like 'Voice of Hindi', 'Rumiyah', 'Khhiafat', 'Dabiq', published by IS.

The victim was riding his motorcycle around 2:00 p.m. when a speeding truck hit him. He was rushed to Civil Hospital, Thane, where he succumbed to his injuries the same day. The compensation was awarded to his two children and estranged wife, with whom he filed for divorce. Despite the separation, the court held her to be a legal heir and dependent. Shrikhande, found the truck driver guilty of rash and negligent driving. The tribunal considered the deceased's employment as a senior supervisor at a private engineering firm, where he earned Rs 27,800 per month. Following Supreme Court guidelines (Pranay Sethi, Sarla Verma), the tribunal applied a multiplier of 14 and included 30% for future prospects. The insurer contended that the truck was driven without a valid heavy vehicle licence and lacked required permits. However, the court ruled that while there was a breach of insurance conditions, it was not fundamental. The insurer was directed to pay the compensation first and recover the amount from the truck owner. The tribunal also granted amounts under funeral expenses, loss of estate, and consortium, along with a 20% increase on conventional heads. Half the compensation will be held in fixed deposits for five years, with the rest equally distributed.

Sasaram: A special court under the Protection of Children from Sexual Offences (POCSO) Act in Bhabhua, Kaimur district, on Thursday sentenced a 22-year-old man to 25 years' rigorous imprisonment for the kidnapping and rape of a minor girl belonging to a scheduled caste community. In addition to the prison term, the court of judge Pramod Kumar Pandey ordered the convict, Golu Singh to pay a fine of Rs 1,07,000. Special public prosecutor Shashi Bhushan Pandey said the incident took place on April 26, 2023, when the girl was waiting for her father near a local intersection. "The accused threatened her and took her to a city hotel, where he sexually assaulted her over four days," he said. Pandey added, "The accused later abandoned her near her village and abused both her and her family with caste-based slurs." The girl's father, who was away for work, filed an FIR upon returning home. After examining the statements of 10 witnesses and reviewing both documentary and forensic evidence, the court found Golu Singh guilty and handed down the sentence.

Quoting from a 1977 Supreme Court judgment, which held that 'adult intent, automatically attributed to infant, is itself an adult error', the Gujarat High Court has quashed an FIR lodged in Rajkot in 2010 against a then minor for alleged rape. The order of Justice J C Doshi of the Gujarat HC on Wednesday considered the submission of the advocate of the petitioner that laid emphasis on Section 83 of the Indian Penal Code (IPC), which stated that 'nothing is an offence which is done by a child above seven years of age and under twelve, who has not attained sufficient maturity of understanding to judge of the nature and consequences of his conduct on that occasion.' The accused was aged under 11 years in 2010. Stating that the Inspector of the Rajkot police station 'must not have the knowledge of Section 83 of the IPC', the HC said that the petition 'deserves consideration', especially since it is not the case of the prosecution that 'forensic test was carried out at the relevant time, that whether the petitioner was, though 11 years old at the time of alleged incident, mature enough to understand the consequences of the alleged act.' The HC order, while citing relevant case laws of the Supreme Court, stated, 'According to this Court, the PI, Bhaktinagar Police Station, must not have knowledge of section 83 of the IPC or (that) filing of FIR is in defiance of section 83 of the IPC. Under the circumstances, present petition requires consideration.' The court also directed the investigating officer concerned as well as the trial court to remove and delete the name of the petitioner from the police records, investigation papers as well as the Registry to protect his identity. The advocate appearing for the minor had submitted to the court that at the time of the incident, the petitioner was ten-and-a-half years old and therefore, 'cannot be treated as accused' under Section 83 of the IPC on the ground of his 'lack of majority'. The petitioner's advocate also submitted that 'no forensic intervention was carried out to establish that he was major (by age) to understand the offence…' The counsel appearing for the complainant of the FIR had submitted that the allegations were 'of serious nature and whether the petitioner is mature or understanding (of) the seriousness of the offence can be tested during trial and the FIR cannot be quashed on the touchstone of reading section 83 of the IPC'. The 2010 FIR was lodged against the minor under IPC Sections 376 (rape), 354 (criminal force against woman with intent to outrage her modesty), 504 (intentional insult with intent to provoke breach of peace), and 114 (abettor present when offence is committed) .
