Motoring influencer ‘Ija', brother jailed a month over faked disappearance, car dumped in river
MUAR, July 25 — An automotive influencer and his younger brother were each sentenced to a month's jail and fined RM1,500 by the Magistrate's Court here today for filing a false police report last week about the former's disappearance. Magistrate Suzana Mokhtar handed down the sentence after both accused, Tengku Nizaruddin Tengku Zainudin, 38, and his brother, Tengku Abdul Aziz, 30, pleaded guilty to their charges. According to the charge, Tengku Nizaruddin, popularly known on Facebook as 'Ija,' was accused of abetting his brother by instructing him to provide false information to a police officer regarding his disappearance. Tengku Abdul Aziz was accused of lodging the false report at the Lenga police station's enquiry office at 11.38 pm on July 15. The pair were charged under Section 182 of the Penal Code for providing false information to a public servant, read together with Section 109 for abetment. The offence carries a maximum penalty of six months imprisonment, a fine of up to RM2,000, or both. How the hoax unfolded The case began after Tengku Abdul Aziz filed a report on his brother's disappearance on July 14. The following day, the Perodua Axia driven by Tengku Nizaruddin was found abandoned in Sungai Tui, Bukit Kepong. This discovery prompted a large-scale search and rescue operation involving the Fire and Rescue Department, police, and the People's Volunteer Corps (Rela). However, Tengku Nizaruddin surrendered at the Lenga police station on July 19 and admitted to faking his disappearance. Police investigations revealed that after dumping his car into the river, Tengku Nizaruddin contacted his brother, who picked him up. The two then travelled to Taman Sri Mawar in Senawang, Negeri Sembilan. From there, Tengku Nizaruddin took an express bus to Thailand via Padang Besar, Perlis. His entry was flagged by the Immigration Department's system, and investigators also found a flight ticket to Hat Yai, Thailand, dated July 17, which had been booked the day before. CCTV footage also placed him at the Seremban Bus Terminal at 9.25 pm on July 14. During mitigation, the brothers' counsel from the National Legal Aid Foundation, Nor Hafizah Abdullah, said her client was prompted to act due to financial problems and not, as some had speculated, to take another wife in Thailand. Tengku Nizaruddin also publicly apologised to all parties and expressed regret for his actions. The prosecution was conducted by Deputy Public Prosecutors Nur Ameerah Allaudeen and Yasmin Mohd Piah.

[UPDATED] Ex-college student who pleaded guilty to infanticide faces sentencing on Aug 8
GEORGE TOWN: The High Court here today fixed Aug 8 for sentencing a former college student who pleaded guilty to infanticide in May this year. Judge Rofiah Mohamad set the date after hearing arguments, including mitigation and a social behaviour report from the Welfare Department's Mohd Zahir Harun. "This is not a simple case. The court needs more time to consider all the arguments to do justice. "As such, the court sets Aug 8 for sentencing," she said today. M. Santhiea, now 23, had on July 16, 2020, been charged with the murder of her newborn at the driveway leading to the fourth-floor parking lot of Sri Ivory Apartment in Air Itam at about 8.25am on July 10 the same year. She was charged under Section 302 of the Penal Code, which carries the mandatory death penalty upon conviction. She was only 18 at the time. It was reported then that the newborn was thrown from the 13th floor of the apartment unit. The teen mother and her 18-year-old boyfriend, with whom she admitted having had sexual intercourse, were detained soon after the incident to assist in investigations. On May 29 this year, she pleaded guilty to an alternative charge of infanticide. The charge was framed under Section 309A of the Penal Code, which states that a woman commits infanticide when she causes her newborn's death while suffering from a disturbed state of mind, having not fully recovered from childbirth. The offence is punishable by up to 20 years' imprisonment and a fine upon conviction. Deputy public prosecutor Nurul Khairiah Dahalaan prosecuted, while Santhiea was represented by a team of three counsels led by RSN Rayer. Earlier during proceedings, Santhiea wept uncontrollably and was seen shivering when shown several photographs of the incident as the facts of the case were presented. She had to be consoled by Rayer and later by her mother. In mitigation, Rayer appealed for his client to be released on a bond of good behaviour. He said the accused, 18 at the time of the incident, could be considered a young offender under the Criminal Procedure Code (CPC). Under the law, he added, the court has the discretion to replace a jail sentence. Rayer said his client had already been remanded for four months since July 2020 when she was initially charged with murder, a charge that carried the mandatory death penalty. "Even at that time, my client and her family went through a living hell. "They were ostracised by society. "As such, I humbly appeal to the court to take all this into consideration and to temper justice with mercy," he said, adding that his client was also an excellent student in school. Rayer also told the court that psychiatric evaluation conducted by Hospital Bahagia Ulu Kinta showed his client suffered from major depressive disorder with anguish and distress. "What happened to my client was truly heartbreaking, something no 18-year-old should have to go through. "She even considered ending her own life. "It is our hope that she is given a second chance to start anew," he added. Rayer also said that only his client was subjected to legal action, while her boyfriend was released without charge. Meanwhile, Nurul Khairiah urged the court to impose a deterrent sentence due to the seriousness of the offence and in the interest of the public. She said the accused had already been given the privilege of a reduced charge despite the gravity of the offence, and had been released on bail since January 2021. "If the child had been given a chance to live, she would have been a cute five-year-old today," she said.

KUALA LUMPUR: A civil servant pleaded not guilty at the magistrates' court today to a charge of outraging the modesty of a woman by asking her to shave his pubic hair in April. Mohamad Aznee Osman, 37, was accused of committing the act on a 23-year-old intern at 1.58pm at a government office here on April 4. The administrative assistant entered his plea after the charge was read out to him before magistrate Farah Nabihah Muhamad Dan. He faces up to five years' jail, a fine, or both upon conviction under Section 509 of the Penal Code. Clad in a black jacket and grey trousers, the father of three who was unrepresented, appeared calm as he stood near the dock during proceedings. Prosecuting officer Inspector M. Alli Nangai offered bail at RM5,000 with one surety. She also requested the court to fix a date for document submission and the appointment of counsel. However, a National Legal Aid Foundation representative appealed for a lower bail amount. "The accused earns RM2,000 a month and is the sole breadwinner of his family. "His wife is unemployed, and they have three children, one of whom is disabled. "The bail should be reasonable and not punitive." Farah Nabihah set bail at RM2,500 with one surety. "I want to remind the accused not to harass any witnesses in this case, especially the victim. "If there are complaints, bail will be revoked," she said.
