J&K LG finds business rules 'contrary to Jammu and Kashmir Act', sends file back to CM Omar Abdullah

Sources in the elected J&K govt told TOI that the file was sent back a couple of days ago, almost two months after it was first submitted for LG's approval after being cleared by the J&K cabinet.
The TBR, which seek to offer clarity on how the secretariat and other govt offices in J&K shall function, were drafted by a high-level committee comprising senior lawyer Rohinton Nariman.
A senior functionary told TOI that the file was returned as TBR were found by the LG's office to be contrary to provisions of the J&K Reorganisation Act.
The TBR propose that all postings and transfers, including of IAS officers, must be approved by the J&K Cabinet. However, Section 53 of the J&K Reorganisation Act clearly states that LG shall, in exercise of his functions, act in his discretion in matters related to All India Services and Anti Corruption Bureau, besides matters that fall outside the powers of legislative assembly or relate to exercise of any judicial functions.
"The TBR seem to claim powers associated with statehood even without statehood. Provisions of the J&K Reorganisation Act have been misinterpreted.... no rules can go beyond the written word in an act of Parliament," said an officer.
The Abdullah govt has been complaining about the posting of IAS officers at the helm of many govt departments in J&K, which earlier were occupied or earmarked for Jammu & Kashmir Administrative Service (JKAS) officers.
Only on April 29, the Abdullah govt had issued transfer orders of 96 JKAS officers.

Srinagar: Three suspected militants were gunned down today July 28 during an encounter with security forces in the higher reaches of Jammu and Kashmir's capital Srinagar. An army spokesperson said that three suspected militants were killed in an 'intense firefight' in the general area of Lidwas which is located in the higher reaches of Harwan-Mulnar area on the outskirts of Srinagar district. The firefight ensued this morning after a joint team of J&K Police and army which was carrying out searches in the area came under heavy fire, prompting retaliatory firing by the forces, reports said. Security forces had launched a search operation following intelligence inputs about suspicious movement in the region whose rugged terrain and dense vegetation offers an ideal transit route for militants to move from south to central Kashmir. Some mountain trails in the area where the encounter took place lead to the Amarnath shrine where more than 3.7 lakh Hindu devotees have paid obeisance amid the ongoing pilgrimage. The annual pilgrimage is this year being held under the shadow of the Pahalgam terrorist attack and the government has deployed thousands of troops to secure the cave shrine. The army spokesperson said that the operation in Lidwas was underway amid apprehensions of the presence of more suspects in the area. The encounter broke out two days after a group of tribal men living in a seasonal habitation in Dhagwan area, which is not far from the site of the ongoing encounter, alleged that they were beaten up by an army official on the charges of providing food and shelter to militants. The army has not however pressed any formal charges against any of the men who suffered injuries of various degrees in the thrashing. Proscribed militant groups such as Jaish-e-Mohammad and Lashkar-e-Tayyaba and their affiliate groups have turned the girdle of mountains circling the Kashmir valley into an active battleground by inflicting heavy casualties on security forces there in the years after Article 370 was read down. Following the Pahalgam terrorist attack on April 22 this year, the Pir Panjal range of mountains, Lidder Valley and Sindh Valley of Kashmir have been closed by security agencies for trekking and other adventure activities while the army and other agencies have stepped up search operations in these regions to flush out any suspects. The Lidwas operation follows a brief lull in firefights between security forces and militants in Jammu and Kashmir in the aftermath of 'Operation Sindoor' when India targeted several terrorist bases in Pakistan occupied Jammu and Kashmir and Pakistan in May this year to avenge the Pahalgam carnage. The last encounter from J&K was reported from south Kashmir in May this year.

Three terrorists killed in gunfight in Srinagar district, identification process underway
Srinagar: Three terrorists were cornered and killed in a gunfight with the security forces under 'Operation Mahadev' in the Dachigam area of J&K's Srinagar district on Monday, the army said. The three terrorists were killed in an intense gunfight with the security forces in the higher reaches of Dachigam National Park near the Mahadev peak in the Harwan area of Srinagar. "The operation is still going on in the area. The exact identity of the slain terrorists is being ascertained," an army official said. The killings of the three terrorists came after an anti-terrorist operation was started on Monday by the security forces in the Dachigam National Park. "The anti-terrorist operation was started following Intelligence inputs. Reinforcements were rushed to the spot as the area is densely populated and the terrain under operation is tough," an official said. The Indian Army, J&K Police and the security forces have been launching aggressive anti-terrorist operations across the area targeting terrorists, Over Ground Workers (OGWs) and sympathisers of terrorism in order to totally dismantle the ecosystem of terror in the UT. The focus previously used to be merely on the elimination of terrorists, but since 2019, Lt Governor Manoj Sinha has given an elaborate and extensive narrative and objective to anti-terrorist operations by speaking of the terror ecosystem and bringing it into focus. The concept of security has since undergone a sea-change as the entire gamut of anti-nationalist operatives, whether armed or not, has been brought under the anti-terrorist operations. After the April 22 terror attack by Pakistan-backed Lashkar-e-Taiba (LeT) terrorists in Baisaran meadow of Pahalgam, in which 26 people were killed, the anti-terrorist operations have been using cutting-edge technology, backed up with human Intelligence to defeat the nefarious designs of the terrorists. J&K Governor Urges Kashmir University Alumni To Power Educational Growth
Srinagar: Jammu and Kashmir Lieutenant Governor Manoj Sinha called upon the alumni of Kashmir University to come forward to strengthen the higher educational institutions of the Union Territory. He made the remarks while addressing the Mega Alumni Meet-2025 at the University of Kashmir in Srinagar on Sunday. Chief Justice of India, Justice Bhushan Ramkrishna Gavai, Union Minister Kiren Rijiju, Judges of the Supreme Court, Chief Justice of the High Court of J-K and Ladakh, Justice Shri Arun Palli, and Chief Minister Omar Abdullah also attended the event. In his address, Sinha extended his felicitations to the alumni and lauded the University of Kashmir for nurturing brilliant minds who have achieved tremendous accomplishments across domains and are driving societal transformation worldwide. "Alumni is not just a network of former students, but a network of human potential which is dedicated towards nation-building," he said. The LG called upon the alumni to come forward to strengthen the higher educational institutions of J-K and use their expertise and network in various sectors to contribute to the peace and progress of the Union Territory of Jammu and Kashmir. He emphasised that the alumni must extend necessary handholding and support to young students in their internships and career prospects, inspire, guide, and empower them, and build a better future for the new generation. "The tradition of selfless sharing is an integral part of our culture. I believe that, in the era of globalisation, alumni connections are the most effective strategy for the growth of any institution and region. University of Kashmir must create an institutional mechanism for the alumni, which will provide them with an opportunity to give back to the university," he said. Sinha emphasised the implementation of the National Education Policy 2020 in educational institutions, in letter and spirit, to restore the past glory of India. "Jammu and Kashmir has done tremendous work in this direction. Our innovative programmes like Design Your Own Degree are serving as inspiration for other higher educational institutions in the country," he said.
