A Muntinlupa City court on Friday stood by its decision to acquit Mamamayang Liberal Representative-elect Leila de Lima and her former driver Ronnie Dayan of conspiracy to commit illegal drug trading charges.
The RTC's action came after the Court of Appeals Eighth Division in April voided the May 12, 2023 decision of the RTC and remanded the case for failure "to discuss the specific proven facts as well as the laws upon which [the judge's] pronouncement of acquittal was based."
In response to the appellate court's order, Muntinlupa Regional Trial Court Branch 204 Judge Abraham Joseph Alcantara insisted that the recantation of former Bureau of Corrections chief Rafael Ragos' testimony was ''sufficient basis for the RTC to uphold the constitutionally guaranteed presumption of innocence.''
Ragos had claimed that he and aide Jovencio Ablen Jr. delivered P5 million in proceeds from the illegal drug trade inside the New Bilibid Prison to De Lima's house in Parañaque City in 2012.
In May 2022, Ragos retracted his testimony against De Lima.
''To reiterate and emphasize, the testimony of witness Ragos is necessary to sustain any possible conviction. Without his testimony, the crucial link to establish conspiracy is shrouded with reasonable doubt,'' the revised decision stated.
''Thus, the undersigned presiding judge submits that the original decision already clearly and distinctly stated the facts and law upon which it was based.''
De Lima spent nearly seven years in detention before she was released on bail in November 2023. The last of her three drug-related cases was dismissed in June 2024. — VBL, GMA Integrated News

De Lima slams Senate's return of VP Sara's impeachment case to House

Representative-elect Leila de Lima of ML Party-list denounced the move of the Senate sitting as an impeachment court to return to the House of Representatives the Articles of Impeachment against Vice President Sara Duterte. 'Harap-harapan na tayong niloloko. Sila ang nagtanong, sila rin ang sumagot. Walang due process. Walang hiya,' de Lima said in a statement. (We are being duped right in front of us. They asked, but they are also the ones who answered. No due process. No shame.) With 18 affirmative, five negative votes, and zero abstentions, the Senate, on Tuesday, voted to return to the lower chamber the Articles of Impeachment against the Vice President without dismissing or terminating them. 'Ano ito—korte o kulto? (What is this — a court or a cult?)' the former senator and incoming party-list said de Lima, who last month accepted invitations to join the prosecution panel of the House of Representatives in the impeachment trial of Duterte. During a plenary session, Senator Ronald "Bato" dela Rosa made a motion seeking that the verified impeachment complaint against the Vice President be dismissed "in view of its constitutional infirmities and questions on the jurisdiction and authority of the 20th Congress." Senate President Francis ''Chiz'' Escudero then ruled that the impeachment court should be convened first before acting on any motion to dismiss the impeachment complaint. When the impeachment court was convened, senators debated on Dela Rosa's motion for hours. Senator-judge Alan Peter Cayetano then moved to amend Dela Rosa's motion that the Articles of Impeachment be returned to the House of Representatives instead, without dismissing or terminating the case. 'There is no rule that allows this. No justice in shutting the door before the people can speak. No truth in a court that silences both sides,' de Lima said. GMA News Online asked Escudero for comment but has yet to receive a reply as of posting time. Escudero on Wednesday however said the House of Representatives has no option but to accept the Articles of Impeachment against Duterte, following the decision of the Senate, sitting as an impeachment court, to return the case back to the lower chamber. The House of Representatives on Wednesday night certified that the impeachment of Duterte complied with the 1987 Constitution. Escudero on Thursday however said the Senate has yet to receive any pleading from the House of Representatives regarding the impeachment of Duterte. The ML Party-list representative-elect further said that the impeachment complaint should have been filed in a 'palengke' or a public market, saying 'pareho lang din—walang nangyaring hustisya… at least doon, may nagtitinda ng totoo (It's the same. There is no justice... At least [in the market], there are vendors who truthfully sell).' 'This is how impunity thrives: pakonti-konti, paisa-isang hakbang, hanggang sa mabaon sa kalokohan ang katotohanan (slowly, one step at a time, until the truth is buried under falsehood),' she said. The incoming lawmaker then praised the senators who voted against remanding the Articles of Impeachment to the House. 'To Senators Risa Hontiveros, Koko Pimentel, Nancy Binay, Win Gatchalian, and Grace Poe: thank you for standing your ground,' de Lima said. 'This is not just a setback. It is a stain—on the Senate, on the law, on the very idea that accountability is still possible in this country,' she said. 'You had one job: to let the truth be heard. Instead, you chose silence dressed as procedure. Delay disguised as order. Cowardice in the costume of rules. "Pero tandaan niyo ito: hindi kami tatahimik. At hindi lahat ng dinadaan sa teknikalidad ay nakakalimutan (But remember this: we will not be quiet. And not all that are processed via technicality will be forgotten),' she added. De Lima further said the 'fight for truth continues—outside your halls, beyond your rules, and with the people who still believe that justice must prevail.' The House of Representatives impeached Duterte on February 5, with over 200 lawmakers endorsing the complaint. Duterte was accused of betrayal of public trust, culpable violation of the constitution, graft and corruption, and other high crimes. Court orders Arnie Teves transfer to Camp Bagong Diwa

A Manila court has denied the motion of former Negros Oriental Representative Arnolfo 'Arnie' Teves Jr. to remain detained under the custody of the National Bureau of Investigation (NBI) at the New Bilibid Prison. In a 5-page order, the Manila Regional Trial Court (RTC) Branch 51 issued a commitment order transferring Teves from the NBI to the Metro Manila District Jail (MMDJ) in Camp Bagong Diwa, Bicutan, Taguig City. Branch 51 handles the Teves murder, frustrated murder, and attempted murder case over the alleged killing of Negros Oriental Governor Roel Degamo and 10 others in 2023. 'This Court finds no merit in the motion of the accused to maintain his custody with the NBI detention facility,' the Court said. In his motion, Teves' camp expressed concern over his safety. It also cited the Certificate of Handover signed by the Timor-Leste and Philippine government prior to the deportation. However, the RTC said the certificate does not state that a specific agency must take custody of Teves as a prerequisite for his transfer. It also did not give weight to Teves' claim that he may be subjected to torture, inhuman, or degrading treatment. 'While the detention facilities in our country may not possess the luxuries a person may have been accustomed to, the detention therein does not automatically make it inhuman or degrading treatment upon one detainee's mere say so,' it said. 'Aside from this claim, the court failed to see any threats against the safety and life of the accused Teves, Jr. mentioned in the motion and how letting him remain in the custody of the NBI facility will secure him against said threats,' it added. The Court said that it appears that Teves is choosing his detention facility 'for his own convenience.' GMA News Online has asked the NBI regarding the possible transfer. The Manila RTC Branch 12, which is handling Teves' illegal possession of firearms and explosives case, has previously ordered his transfer to the Manila City Jail. NBI Director Jaime Santiago, however, held off the transfer, explaining that several courts are handling Teves' cases and may order his detention in other areas. Teves and several others have also been charged with the alleged killings of three individuals in Negros Oriental in 2019. He and 12 others have also been designated as terrorists by the Anti-Terrorism Council, citing several alleged killings and harassment in Negros Oriental. — RSJ, GMA Integrated News
