Kendrapada: Additional district judge-cum-special judge (Pocso) in Jajpur has sentenced a 27-year-old man to 20 years of rigorous imprisonment for the kidnapping and rape of a 16-year-old girl.
The verdict was delivered on Wednesday, marking a crucial step in the fight against crimes against minors.
The convict, Dusmanta Jena, was fined Rs 30,000. Failure to pay the fine will result in an additional six months of imprisonment. The court has directed the Odisha State Legal Services Authority (OSLSA) to compensate the girl with Rs 2 lakh.
The incident dates back to April 9, 2023, when the girl was abducted while returning home from college.
Following the filing of an FIR, police swiftly launched an investigation, leading to Jena's arrest and rescuing of the girl from Vijayawada three days later.
Judge Abhijit Palei, while pronouncing the verdict, relied on the testimonies of 13 witnesses, including the girl's, and the medical report. Jena was convicted under Section 376 of the IPC (rape) and Section 6 of the Protection of Children from Sexual Offences Act, 2012.
Special public prosecutor Rajiv Mohanty emphasised the importance of the ruling, stating that it underscores the judiciary's commitment to delivering justice in cases of sexual offenses against minors.

UDUPI: A resident of Udupi allegedly lost over Rs 6 lakh after being duped by a YouTube advertisement that promised daily earnings. In his complaint, Gaurish stated that while browsing YouTube in May, he came across an advertisement titled 'Daily Earning Rs 1,000 to Rs 3,000.' On clicking the link, he was redirected to WhatsApp via his mobile number and received a message promoting online income opportunities. The sender shared details about online part-time jobs and added Gaurish to a WhatsApp group named 'Daily Part-Time Earning Group.' The group circulated further job-related tasks and instructed him to invest money to complete them. Between 29 May and 15 July, the complainant reportedly transferred a total of ₹6.05 lakh through Google Pay and internet banking in multiple instalments to bank accounts provided by unknown individuals. However, neither the invested amount nor the promised returns were paid back. Based on the complaint, a case was registered at the CEN Crime Police Station under Sections 66(C) and 66(D) of the IT Act and Section 318(4) of the Bharatiya Nyaya Sanhita (BNS).

Jaipur: Piplodi village in Rajasthan's Jhalawar district plunged into deep sorrow on Saturday as six of the seven children who lost their lives in the tragic school building collapse were cremated together. One child was taken to the nearby village of Chandpura Bhilan for the final rites. As the bodies of the six children arrived in Piplodi early in the morning, cries of anguish filled the air. The silence of mourning was broken by heart-wrenching screams, as grieving families and villagers gathered to bid farewell to the young souls. In the presence of the Superintendent of Police and other administrative officials, the bodies were handed over to the families at 5:00 AM. From the Manohar Thana Hospital, the deceased were transported to their respective homes in separate vehicles. The atmosphere in the village turned chaotic with the arrival of the bodies, as sorrow gripped every household. Preparations for the cremation had begun even before the arrival of the bodies. The remains were quickly taken to the cremation ground near the accident site under heavy police presence. A tragic moment unfolded as the bodies of siblings Kanha and Meena were carried together on a single bier. The final rites of all six children were performed at the cremation ground on five pyres. Fathers of the deceased lit the pyres, and as the flames rose, tears flowed freely. The seventh child was cremated in Chandpura Bhilan village. The village of Piplodi is cloaked in grief and anger. In two families, the only child was lost, while in another, both children perished. Most of the deceased were between 7 to 10 years old and belonged to families struggling with poverty. Many of the parents are daily wage labourers, now left shattered by the loss of their children. In a compassionate gesture following the tragic collapse of a government school building in Jhalawar's Manoharthana block, the Rajasthan government has announced an ex gratia of Rs 10 lakh and a contractual job for the families of the seven children who lost their lives. Additionally, classrooms in newly constructed school buildings will be named in memory of the deceased students. The devastating incident took place on Friday when a portion of the building at Piplodi Government School collapsed, leaving seven children dead and 21 others injured, of whom nine remain in critical condition. Education and Panchayati Raj Minister Madan Dilawar visited the injured children at SRG Hospital in Jhalawar. Dilawar said, "I take full responsibility for this incident." Following a preliminary inquiry, the Education Department suspended five teachers, including the headmaster of the school. Meanwhile, public outrage intensified after the incident. Villagers, protesting at Burari intersection in Manoharthana, pelted stones at police personnel, resulting in damage to police vehicles.

The court said while the DNA test confirmed the man was the child's father, absence of supporting oral evidence, especially from the victim, rendered the case legally insufficient The Karnataka High Court recently declined to interfere with the acquittal of a man accused of raping a minor, holding that a DNA match proving paternity does not automatically establish guilt under criminal law. The state had approached the Dharwad Bench of the High Court seeking to overturn the August 2021 acquittal of a 24-year-old man from Belagavi district, who was tried under Section 376(2) of the IPC and Sections 4 and 6 of the Protection of Children from Sexual Offences (POCSO) Act. However, the high court refused to do so, reasoning that while the DNA test confirmed he was the father of the child born to the victim, the absence of any supporting oral evidence, especially from the victim herself, rendered the prosecution's case legally insufficient. The prosecution case was that in January 2015, the accused, then working as a daily wage labourer, allegedly entered into a sexual relationship with a 17-year-old girl in a remote area near Kyadagi forest, Uttara Kannada. The girl later became pregnant. However, it was only a year later that she lodged a police complaint after the accused began to avoid her. A medical examination confirmed her pregnancy, and a DNA test later matched the accused as the biological father of the baby. But at trial, the victim, along with her close family members, turned hostile, denying that any sexual contact had taken place. With 22 witnesses examined and 37 documents submitted, the prosecution pinned its case almost entirely on medical and forensic evidence. The trial court, however, found the evidence inadequate to meet the threshold of 'beyond reasonable doubt" and acquitted the accused. Challenging this, the state contended that the DNA evidence alone was conclusive of the offence. The high court disagreed. In its judgment delivered on July 10, the bench of Justices R Nataraj and Rajesh Rai K underlined that scientific evidence such as DNA tests must be evaluated in the broader context of all available facts and testimonies. 'The victim herself firmly stated that the accused did not have any sexual intercourse with her. She is not aware who the father of her child is. Even her parents and relatives also deposed similarly. In such circumstance, the DNA report cannot be solely relied to convict the accused," the bench observed. The court drew upon precedents from both the Supreme Court and other high courts, emphasising that DNA profiling is rooted in statistical probability and cannot be treated as infallible. It also warned against treating such reports as conclusive in the absence of procedural safeguards around collection, preservation, and contamination. Citing the principle that appellate courts should not lightly interfere with acquittals where the trial court has taken a plausible view, the high court declined to re-evaluate the trial court's findings.
