Ex-Pahang MB Adnan Yaakob Fails In Appeal To Overturn RM84,000 Penalty Imposed By SC

PUTRAJAYA, July 31 (Bernama) -- Former Pahang menteri besar Tan Sri Adnan Yaakob failed in his appeal today to overturn a summary judgement requiring him to pay an RM84,000 penalty to the Securities Commission (SC) for breaching provisions under the Capital Market and Services Act 2007 (CMSA).
A three-man bench led by Justice Datuk Azimah Omar held that Adnan should have filed a judicial review to challenge the penalty, adding that on that ground alone, the appeal was bound to fail.
Furthermore, she said Adnan failed to raise any triable issues in the light of his clear and unequivocal admission in his letter to the SC.
The panel, also comprising Justices Datuk Wong Kian Kheong and Datuk Ismail Brahim, ordered Adnan to pay RM10,000 in legal costs.
Adnan, who served as Pahang menteri besar from 1999 to 2018, was a member of the Board of Directors of Pasdec Holdings Bhd (PASDEC), whose largest shareholder is the Pahang State Development Corporation (PKNP) (Perbadanan Kemajuan Negeri Pahang).
The SC, a statutory body established under the Securities Commission Act 1993 (SCMA), is vested with the functions and powers to enforce compliance with the SCMA and CMSA.
On May 16, 2018, PASDEC issued an abridged prospectus that omitted material information.
PASDEC failed to disclose PKNP's application for approval to subscribe to its entitlement at the issue price of RM0.35 per rights share, was still pending.
As a member of the PASDEC's board of directors, Adnan, 75, had individually and collectively accepted responsibility for the omission.

In a statement issued yesterday, the branch's publicity secretary Fang Toung Shyuan acknowledged the government's intent of preventing retirees from misusing their EPF savings and potentially falling into financial hardships. However, he also stressed about the retirement funds rightfully belonging to the contributors. 'EPF savings are the result of a member's lifelong hard work. 'Once they reach retirement age, the funds belong to them, not the EPF. 'Imposing mandatory restrictions on how these savings can be accessed is unjustified,' he said in the statement. Fang called upon the government to respect the voices and feedback of EPF contributors, whose funds had been accumulated over many years of employment. He argued that retirees should not be subjected to a rigid, one-size-fits-all policy, especially when many already had personal retirement plans in place. 'At the very least, members must be free to choose their preferred method of withdrawal,' he said. Fang also expressed concern over recent declines in EPF investment returns, which he warned could lead to public suspicion that the proposed policy served as a means for the government to shift financial risk to the people. He noted that some contributors planned to use their EPF savings to start small businesses, invest, support their children's ventures, or to make home purchases. Furthermore, he cited EPF's data reporting that around 50 per cent of members had less than RM10,000 in their accounts at retirement funds. 'If a monthly disbursement system is enforced, it could mean receiving only a few hundred ringgit per month, which may last just two to three years.' 2 Bangladeshi cyclists killed in hit-and-run

MUAR: Two Bangladeshi cyclists were killed and a fellow country man seriously injured after a hit-and-run in Parit Salam, Parit Yusof, here last night. The 8.45pm crash occurred when the three Bangladeshi men, all aged 21, were cycling against traffic from Parit Yusof towards Bukit Mor before an unidentified vehicle heading in the opposite direction crashed into them. District police chief Assistant Commissioner Raiz Mukhliz Azman Aziz said initial investigations revealed the vehicle hit the trio, flinging them onto the left shoulder of the road. One cyclist died on the spot, while another succumbed to his injuries while he sought treatment at the Muar hospital's red zone. The third victim suffered fractures to his right wrist and shoulder and is treated in the hospital's yellow zone. As per press time, the driver is yet to lodge a report. "Investigations are underway to identify the driver, and vehicle involved to facilitate investigations for reckless driving causing deaths," he said in a statement today. If convicted, the offender faces up to 10 years' jail and a RM50,000 fine. Raiz urged witnesses to come forward and assist the investigation. PolyCC graduate employability hits 98.8% in 2024

MELAKA: Polytechnics and Community Colleges (PolyCC) continue to demonstrate the effectiveness of the national Technical and Vocational Education and Training (TVET) system, achieving an impressive graduate employability rate of 98.8 percent in 2024. Higher Education Ministry Secretary-General (KSU) Datuk Dr Anesee Ibrahim said the achievement was the result of strong collaboration between PolyCC and nearly 20,000 industries through the implementation of high-impact programmes such as Work-Based Learning, Structured Industrial Training, as well as Professional and Competency Certification. 'The academic programmes offered at PolyCC are ensured to gain accreditation and recognition from authorised professional bodies such as the Malaysian Qualifications Agency (MQA), the Malaysia Board of Technologists (MBOT), and professional certification agencies. 'This accreditation proves that Polytechnic and Community College graduates receive formal recognition from the government, both domestically and internationally, as well as from relevant industries,' he said in Ayer Keroh here today. He was speaking at the 22nd Convocation Ceremony of Politeknik Melaka, which was also attended by Dr Shamsuri Abdullah, Deputy Director-General (Planning) of the Department of Polytechnic and Community College Education. Elaborating further, Anesee said efforts to produce well-rounded and entrepreneurially-minded graduates were also being emphasised, with 119 entrepreneurship incubators successfully established this year, involving 476 students and generating nearly RM800,000 in sales. 'Students are exposed to various programmes during their studies, including skills competitions, entrepreneurship activities, research, volunteerism, and sports, to shape holistic and dynamic character,' he said. He added that PolyCC is also actively forging partnerships with various international institutions from countries such as Russia, Japan, Korea, Türkiye, China and Indonesia, to strengthen academic and research collaboration in line with the ministry's focus on the internationalisation of higher education. 'This move aligns with the ministry's aspiration to strengthen Malaysia's position as a world-class higher education hub, while elevating PolyCC as a leading TVET institution at the international level,' he said. Anesee noted that PolyCC now stands as a premier TVET institution with 36 polytechnics and 106 community colleges, involving nearly 15,000 staff and 97,000 active students, including in Melaka, which hosts two polytechnics and six community colleges. 'This year, a total of 32,087 graduates from polytechnics and community colleges will have been or are being celebrated in 28 convocation ceremonies held nationwide,' he said. - Bernama
