BJP reiterates demand for public apology from Congress for imposing Emergency; panel to look into Kolkata law college rape
The Bharatiya Janata Party (BJP) Saturday reiterated its demand for a public apology from the Congress for imposing the Emergency on the occasion of its 50th anniversary observed recently.
Addressing a press conference at the party's national headquarters, BJP national spokesperson Sambit Patra accused the Congress of trying to mislead the people over the issue despite proof that it had made changes to the Constitution under the then Prime Minister Indira Gandhi's watch during the period.
He also announced the formation of a four-member fact-finding committee tasked with visiting West Bengal in the aftermath of the rape incident at a law college in Kolkata. The committee, constituted on the instructions of BJP president J P Nadda, includes former Union minister and Mumbai police commissioner Satya Pal Singh, ex-Delhi MP Meenakshi Lekhi, Lok Sabha MP Biplab Deb and Rajya Sabha MP Manan Kumar Mishra.
Citing media reports from the period, related to Indira Gandhi questioning the Constitution, Patra said, 'This is the biggest slap in the face of those who accuse us of seeking to change the Constitution. Indira Gandhi-ji had said that her first task (after coming to power) will be to amend the Constitution.'
The BJP has chosen to reiterate its demand of an apology from the Congress, referring to amendments to the Constitution during the Emergency in reply to the Opposition party's attack after RSS sarkaryavah Dattatreya Hosabale called for a discussion on whether the words 'socialist' and 'secular', inserted in the Preamble of the Constitution during the Emergency should remain intact.
Union ministers Shivraj Singh Chouhan and Dr Jitendra Singh threw their weight behind the idea on Monday in response to the Congress's criticism of Hosabale's remark. The BJP has not commented on the RSS leader's suggestion.
On Monday, BJP national spokesperson Sudhanshu Trivedi had attacked the Congress for being 'behind every act of tampering with the Constitution and its spirit' over the last seven decades, and demanded that it should apologise for the Emergency.
Referring to another news item stating that she had questioned whether the Constitution was truly serving the people, Patra said these were the requisite answers for those in the Congress who were questioning the commemoration of the 50th anniversary of the Emergency.
Attacking both the Trinamool Congress (TMC) and its government in West Bengal following the Kolkata law college rape incident, Patra said the state's condition was painful to consider. '(TMC MP) Kalyan Banerjee says what can we do if a friend rapes another friend… What kind of mentality is this? The Mamata Banerjee government in Bengal believes it has no accountability… The guard room which should be one of protection is where the rape happened. Nothing can be more horrible than this,' he said, announcing the formation of the fact-finding committee.
'There is no doubt that absolutely everyone is pained at what is happening there…Mamata Banerjee should tender both an apology and her resignation. Such treatment of women is simply unacceptable,' he added.

Complaint filed against RSS general secretary Hosabale over Preamble remarks
A police complaint has been filed against Rashtriya Swayamsewak Sangh general secretary Dattatreya Hosabale, accusing him of making 'unconstitutional, inflammatory and divisive' comments and seeking legal action against him. RSS general secretary Dattatreya Hosabale stoked a political controversy last week over his comments on the Preamble of the Constitution (PTI) The complaint, filed by members of the Karnataka legal cell of the Indian Youth Congress, said that Hosabale's recent comments seeking to remove the terms 'socialist' and 'secular' from the Preamble of the Indian Constitution were an 'attack on the constitutional ethos' and an 'incitement against the nation's founding values'. The complaint was filed at the Seshadripuram Police Station in Bengaluru on Sunday. While the police acknowledged the receipt of the complaint, no FIR was filed till the time of going to print. 'I am filing this complaint in the interest of protecting the sanctity of the Constitution of India and preserving public order and constitutional values as a dutiful citizen of India,' the complainant, Shreedhar MM, a representative of the Youth Congress, said. 'These remarks are not just ideational commentary. They are deliberate, provocative, and dangerous.' The complaint said that Hosabale's speech violated several provisions of the Bharatiya Nyaya Sanhita and amounted to 'an attempt to marginalize religious communities and promote disharmony'. 'These are not protected political speech,' the complainant wrote. 'They are an incitement to constitutional subversion and fall within the purview of cognizable criminal offenses.' The RSS leader stoked a political controversy last week, when, speaking at an event in Delhi on Thursday, he said, 'During the Emergency, two words, secular and socialist, were added to the Constitution, which were not part of the original Preamble. Later, these words were not removed. Should they remain or not… a debate must happen on this. These two words were not in Dr Ambedkar's Constitution. During the Emergency, the country had no functioning Parliament, no rights, no judiciary and yet these two words were added.' The changes were among those made in the contentious 42nd Amendment, passed in 1976. Citing his speech, the Congress workers sought legal action against Hosabale. 'Such attempts to publicly erode constitutional values must be treated with utmost seriousness and urgency,' the complainant added. 'A clear message must be sent that no one is above the Constitution.'

Oppn protests roll revision, still deploys 56,000 BLAs in Bihar
1 2 New Delhi: Despite their disgruntlement and protests over the ongoing special intensive revision (SIR) of Bihar's electoral roll, the state's opposition parties have already joined the exercise in full strength, deploying over 56,000 booth level agents (BLAs) to monitor every stage of the process. For instance, RJD has appointed 47,143 BLAs, making it second only to BJP that has positioned 51,964 BLAs in the field. Congress has appointed 8,586 BLAs, CPI(ML) (Liberation) 233, CPM 76 and BSP 26. BJP allies JD(U), Lok Janshakti Party and Rashtriya Lok Samta Party have appointed 27,931, 2,457 and 264 BLAs, respectively, taking the total deployment by NDA to 82,616 BLAs. Election Commission sources told TOI on Sunday that all political parties are in the process of appointing more BLAs for proper verification of electoral rolls. EC officials, despite facing criticism of SIR as an attempt at "disenfranchisement", sought to make it crystal clear on Sunday that the poll body will strictly implement Article 326 during the exercise. It's a straight question (to the parties criticising SIR): Do you agree with Article 326 or not," asked the functionary. "Political parties and other persons are supposed to follow Article 326 in letter and spirit. EC has allowed BLAs to file applications in bulk, subject to the condition that a BLA would not submit more than 50 forms per day to a BLO before the draft roll publication, and 10 forms per day thereafter. BLAs will submit a list of application forms with an undertaking that he or she has personally verified the particulars of the application forms and is satisfied that they are correct.
