Delhi Government to urge Supreme Court to allow uniform rules on overage vehicles: CM Gupta
Lieutenant Governor Vinai Kumar Saxena has also written to Ms. Gupta urging her government to file a review petition in the Supreme Court, saying that it is 'irrational to imagine that a 10-year-old Diesel vehicle has reached its end of life in Delhi while remaining roadworthy in other parts of the country.'
A 2018 Supreme Court judgement banned diesel vehicles older than 10 years and petrol vehicles older than 15 years in Delhi in an attempt to reduce vehicular pollution in the Capital.
The L-G in his letter wrote that he acknowledges that the Air pollution is a shared responsibility and must be addressed with urgency and foresight. He called for a more balanced and technologically advanced framework to deal with vehicle emissions. 'The policy execution must also reflect principles of legality, fairness, and socioeconomic sensitivity,' Mr. Saxena said.

Speaking to reporters on the sidelines of an event, Ms. Gupta said 'We will tell the Supreme Court about the pollution control measures taken by the government. The parameters that are applicable in the entire country should also apply to Delhi. We want Delhiites not to face any inconvenience.'
Last week, Environment Minister Manjinder Singh Sirsa wrote to the Commission for Air Quality Management (CAQM) to put on hold its direction to deny fuel to end-of-life vehicles at fuel stations and also impound such vehicles identified through Automatic Number Plate Recognition (ANPR) cameras installed at the fuel stations. But the CAQM is yet to officially respond or issue any statement in this regard.

On April 23, the CAQM had directed that all ELVs identified through the ANPR cameras or other such systems installed at the fuel stations shall be denied fueling from July 1 in Delhi and from November 1 in five districts of Gurugram, Faridabad, Ghaziabad, Gautam Budh Nagar and Sonipat and from April 1, 2026 in the rest of NCR.
The Delhi Government supported the CAQM's directions and from July 1, the Transport Department of the Delhi government and traffic police started to impound ELVs reaching the fuel stations. However, days later, Mr. Sirsa wrote to the CAQM asking them to put on hold the ban.

"We will tell the Supreme Court about the pollution control measures taken by the govt. The parameters that are applicable in the entire country should also apply to Delhi. We want Delhiites not to face any inconvenience," she said, adding that they are committed to providing relief to people. Till March this year, there were more than 60 lakh overage vehicles in Delhi. The previous year, 39,273 were scrapped while in 2023, the figure stood at 22,397. In his letter, Sirsa said that a stage-wise implementation that begins only in Delhi will not serve its intended purpose. "It is highly likely to lead to vehicle owners procuring fuel from adjacent districts like Gurgaon, Faridabad and Ghaziabad, thereby circumventing the ban and potentially fostering an illegal cross-border market for fuel, which would further exacerbate the problem," he said.

SC opens up staff jobs for OBC and SC/ST blocs, 'omits' EWS
Supreme Court (AI-generated image) NEW DELHI: CJI B R Gavai, second from the Dalit community to head the judiciary, has amended the Supreme Court Officers and Servant (Conditions of Service and Conduct) Rules, 1961, to provide for reservations to SCs, STs, OBCs, physically challenged, ex-servicemen and dependents of freedom fighters in direct recruitments to subordinate staff of the apex court. Rule 4A of the Act, amended and substituted on the CJI's instructions, has been gazetted through a notification issued on July 3. However, it omits reservation for candidates belonging to the economically weaker section (EWS), which was introduced by Parliament through Constitution (103rd Amendment) Act, 2019. The substituted Section 4A, as gazetted, reads: "Reservation in direct recruitment to various categories of posts specified in the Schedule, for the candidates belonging to SCs, STs, OBCs, Physically Challenged, Ex-servicemen and dependant of Freedom Fighters shall be in accordance with the Rules, orders, and Notifications issued from time to time by the Government of India in respect of posts carrying the pay scale corresponding to the pay scale prescribed for the post specified in the Schedule, subject to such modification, variation or exception as the Chief Justice may, from time to time, specify. " The 103rd Constitutional Amendment Act introduced Articles 15(6) and 16(6) to give effect to 10% reservation for EWS in govt jobs and admissions to govt and govt-aided educational institutions. It received Presidential assent on Jan 12, 2019. The constitutional validity of EWS quota was challenged in Supreme Court by more than 20 petitions, mainly on the ground that it exceeded the 50% ceiling on quota imposed by SC in its Indra Sawhney judgment in 1992. A five-judge bench led by then CJI U U Lalit on Nov 7, 2022, by three to two majority, declared that Parliament's decision to provide quota for EWS category was constitutionally valid. The majority view was shared by Justices Dinesh Maheswari, Bela M Trivedi and J B Pardiwala, while Justices Lalit and S R Bhat ruled that EWS quota was illegal. On Dec 6, 2022, NGO 'Society for the Rights of Backward Communities' filed a petition seeking review of the Nov 7 judgment. A five-judge bench led by then CJI D Y Chandrachud on May 9, 2023 dismissed the review petition, thus giving judicial impregnability to the validity of the EWS quota.
