In a move that could have significant implications for automakers, the owner of a 2024 Mazda CX-90 has taken legal action against Mazda, alleging the company failed to properly address an ongoing brake noise issue. At the center of the case isn't a complex mechanical failure but a high-pitched brake squeal—loud enough, according to the complaint, to cause public embarrassment and raise serious safety concerns.
The plaintiff claims the shrill sound produced when applying the brakes is sudden, jarring, and disruptive, particularly during emergency stops. He argues that it not only undermines confidence in the vehicle but also creates potentially dangerous driving conditions.
Early Complaints, Limited Solutions
The issue first emerged when the vehicle had covered fewer than 840 miles (1,352 km). Upon visiting the dealership, the owner discovered that the service team was already familiar with the complaint. They initially lubricated the brake pads and calipers, which reduced the noise temporarily.
However, the relief didn't last. On subsequent visits, technicians tried further remedies—polishing the rotors and pads, and applying materials meant to dampen sound and vibration. Yet the squealing persisted. Despite multiple repair attempts, the noise kept returning, prompting repeated trips to the dealership.
During one of these visits, a technician revealed an internal Mazda technical bulletin from 2024 that acknowledged the problem. But there was no permanent fix—nor an official recall.
Legal Action on Grounds of Negligence
Frustrated, the owner filed a lawsuit in California, accusing Mazda of negligence and breach of its responsibilities to customers. He contends that Mazda sold a car with a known, unresolved flaw, and that the temporary fixes offered were insufficient. According to the complaint, he spent over $1,500 (5,625 SAR) trying to resolve the issue, with no lasting success.
The legal filing claims that Mazda failed to inform customers about the defect and failed to develop or communicate a definitive solution—leading to an ownership experience described as both stressful and unsafe.
A Widespread Complaint?
Reports from other CX-90 owners suggest this case may not be isolated. Discussions on forums and social media show several drivers have noticed similar brake noise, often likened to 'metal scraping metal.' Some owners say Mazda attributed the sound to typical brake behavior in certain environments or as part of the normal break-in process for new vehicles.
Still, critics argue that such explanations fall short, especially when the noise is so loud that it disrupts concentration and contributes to a feeling of instability while driving.
From a Service Issue to a Trust Crisis
While Brake Noise might seem like a minor annoyance, this case illustrates how seemingly small flaws can damage a brand's credibility. For the affected owner—and many others—what began as a service request has turned into a symbol of frustration, costly repairs, and corporate silence.
If Mazda fails to respond with a transparent and lasting resolution, it may face increasing legal pressure, and possibly, a broader recall. What's at stake isn't just noise—it's consumer trust.

Kyle Larson raced to his third NASCAR Cup victory of the season at Kansas in mid-May then turned his attention to his second and perhaps final attempt at racing's double–completing all 1100 miles of the Indianapolis 500 and Coca-Cola 600 on the same day. Instead, he was hit with a double whammy. A crash on Lap 92 knocked him out of the 500, relegating him to 24th, and two crashes–the second on Lap 245–knocked him out in Charlotte where he finished 37th. Not much has gone right for Larson since then. He posted just one top five finish over the next eight races before finishing fourth at Dover last weekend. Now the defending Brickyard 400 champion is back at Indianapolis Motor Speedway trying to recharge his season. 'It's great to be back here in Indy and back at the track; hopefully I'll do a much better job than I did in May,' he said Friday. 'It's a privilege to get to run here, and I would love nothing more than a good run and hopefully kind of put the bow on the double stuff.' Only three drivers in race history own back-to-back Brickyard wins–Jimmie Johnson in 2008-09, Kyle Busch in 2015-16, and Kevin Harvick in 2019-20. Larson's won last year on Indy's historic 2.5-mile oval instead of the road course used the previous three years. Most, if not all drivers, including Larson, prefer running the oval. 'There's so many people from all over the world here, whether it be May or our events or really for that matter any events,' Justin Allgaier said. ... 'It's just there's nothing quite like it.' Larson understands, having driven an IndyCar on the oval each of the last two Mays and now back in a Cup car his fourth start in 14 months at the Brickyard. The difference this year: Larson wants to change directions after some sub-par results. But they have not dashed his championship hopes. The 2021 Cup champ is tied for second in wins this season already has accrued 23 playoff points and trails only Hendrick Motorsports teammates Chase Elliott, the 2020 Cup champ, and William Byron in points. Neither Elliott nor Byron has won the 400 though. Neither has Denny Hamlin, who sits just behind Larson in points despite winning a series-best four times including last weekend at Dover. He also signed a two-year contract extension with Joe Gibbs Racing on Friday. If he can add a win Sunday to the three he's had in the Daytona 500 and Southern 500 and the one Coca-Cola 600 title, Hamlin would join the short list of drivers who have won all four Cup crown jewel races in their career. 'It certainly would mean a lot to me,' said Hamlin, who has started 16 Brickyards. 'We've come close. We were actually as close on the road course as we were on ovals although I don't know–you could argue whether that (road race) was actually a crown jewel or not. So yeah, highly motivated.' But things already are off script for Larson, Hamlin, and everyone else in Indy. Friday's scheduled practice was rained out, making the second week in a row practice was washed out. Qualifying is scheduled for Saturday when temperatures are forecast to be in the mid to upper 80s with rain in the forecast most of the afternoon. The forecast for Sunday looks almost identical to Saturday. That's not what Larson wanted to hear even though race organizers rescheduled a short practice for Saturday afternoon. 'Hopefully our car is good again,' he said before the scheduled practice. 'I believe it should be fast if not better than it was last year. So you know, hopefully we'll have a good practice good qualifying (Saturday) and execute a good race on Sunday.' Larson's goal is simple–qualify up front, stay up front, and stay out of the trouble he's found far too routinely lately. 'When (Christopher Bell) spun (at Dover), I thought I was going to get collected and be like 'Uh oh just continuing our bad luck here,'' he said. 'So hopefully this is the beginning of us to kind of turn things around. We'll see.

'He is understandably disappointed that he will not be able to take the court to start the season, but his health is our No. 1 priority. We have no doubt that he will come back even stronger. We look forward to supporting him during this process.' Arenas, whose father Gilbert played in the NBA, was involved in a car crash that left him in an induced coma in April. He crashed his Tesla Cybertruck into a tree, smoke filled the front cabin, and the doors wouldn't open. He spent nearly 10 minutes in the burning vehicle before bystanders helped pull him to safety. Arenas was in the hospital for six days but did not suffer major injuries. He is a five-star recruit and 2025 McDonald's All-American. The 2024 John R. Wooden High School Player of the Year is also the top scorer in CIF LA City Section history, accumulating 3,002 points in three years of high school.

NEW YORK: The fallout from Elon Musk's plunge into politics a year ago is still hammering his Tesla business as both sales and profits dropped sharply again in the latest quarter. The car company that has faced boycotts for months said Wednesday that revenue dropped 12 percent and profits slumped 16 percent in the three months through June as buyers continued to stay away. 'The perception of Elon Musk, its chief executive, has rubbed the sheen right out of what once was a darling and soaring automotive brand,' wrote Forrester analyst Dipanjan Chatterjee in an email. Tesla is 'a toxic brand that is inseparable from its leader.' Quarterly profits at the electric vehicle, battery and robotics company fell to $1.17 billion, or 33 cents a share, from $1.4 billion, or 40 cents a share. That was the third quarter in a row that profit dropped. On an adjusted basis, the company said it earned 40 cents a share, matching Wall Street estimates. Revenue fell from $25.5 billion to $22.5 billion in the April through June period, slightly above Wall Street's forecast. Tesla shares were little changed in after-hours trading as investors wait to hear from Musk on the company's earnings call later in the afternoon. Musk, who helped elect President Donald Trump with a massive campaign donation and then headed his DOGE cost-cutting program, has been pinning the future of the company less on car sales and more on robotaxis, automated driving software and robotics. But those businesses are yet to take off, and the gap between promise and profits was apparent in the second quarter. A big challenge is that potential buyers not just in the US but Europe are still balking at buying Teslas. Musk alienated many in the market for cars in Great Britain, France, Germany and elsewhere by embracing far-right candidates for office on the continent. And rival electric vehicle makers such as China's BYD and German's Volkswagen have pounced on the weakness, stealing market share. Tesla began a rollout of its paid pickup robotaxi service in Austin, Texas, and hopes to introduce the driverless cabs in several other cities soon. Musk has said he expects to have hundreds of thousands of the cabs on US roads by the end of next year. In a conference call after the results were announced, Musk said the service will be available to probably 'half of the population of the US by the end of the year — that's at least our goal, subject to regulatory approvals.' He added, 'We are being very cautious. We don't want to take any chances.' The test run in Austin has mostly gone off without a hitch, though there have been a few alarming incidents, such as when a robotaxi went down a lane meant for opposing traffic. With driverless taxis, though, the billionaire who upended the space race and the EV manufacturing faces tough competition. The dominant provider now, Waymo, is already in several cities and recently logged its ten-millionth paid trip. Meanwhile other threats loom. The new federal budget just passed by Congress eliminates a credit worth as much as $7,500 for buying an electric car. It also wipes out penalties for car makers to exceeding carbon emission standards. That threatens Tesla's business of selling its 'carbon credits' to traditional car companies that regularly fall short of emission standards. Tesla generated $439 million from credit sales, down sharply from $890 million a year ago. One way to boost sales that Musk has long promised: A cheaper model. The company now is planning to introduce that to the market in the last three months of the year. Tesla had previously said that was going to happen by June this year. 'It appears management's focus will now shift to robotaxis and away from deliveries growth,' said Morningstar analyst Seth Goldstein, referring to the car sales. 'If Tesla continues to execute well with vehicle autonomy and humanoid robot autonomy,' Musk said in his remarks, 'it will be the most valuable company in the world.' Musk also said he expected regulatory approval to introduce its so-called Full Self-Driving software in some parts of Europe by the end of the year. Musk had previously expected that to happen by March of this year. The feature, which is available in the US, is a misnomer because it is only a driver assistance feature. Gross margins for the quarter, a measure of earnings for each dollar of revenue, fell to 17.2 percent from 18 percent a year earlier. A highlight from the quarter was from something far removed from cars and robots: the company's investment in bitcoin. That bet generated a $284 million paper gain, compared with a loss the previous quarter.
