Workplace reform: Women may soon be allowed night shifts in Delhi; labour department told to amend laws

Time of India02-07-2025
NEW DELHI: Delhi govt has directed the labour department to make necessary changes in laws to allow women to work night shifts, but only with their consent.
Officials said the directions were issued during a meeting chaired by lieutenant governor VK Saxena, which was also attended by chief minister Rekha Gupta, some of her colleagues in the council of ministers, and top city bureaucrats.
The meeting aimed to review the status and progress of various aspects related to the flagship schemes, 'ease of doing business' and 'maximum governance - minimum government'.
Officials mentioned that the previous Delhi govt gave its nod to do away with section 66(1)(b) of the Factories Act of 1948. This section stated that no woman shall be required or allowed to work in any factory except between the hours of 6 am and 7 pm.
The govt also approved the draft of the Delhi Occupational Safety, Health and Working Conditions Rules, 2023, which allowed women to work during night shifts. However, these provisions were never implemented on the ground.

Saxena stated that restrictive and archaic laws, processes, and regulatory regimes hampered and discouraged businesses and economic activities. LG and the chief minister asserted that progress during the last 11 years was "far from satisfactory" and that difficulty in doing business led to a situation where industries and businesses shifted to other states.

They issued a slew of directions to re-engineer the govt processes.
Officials said the labour department was also directed to ensure all safeguards by amending the Delhi Shops and Establishment Act and by issuing suitable notifications under the Factories Act. It was also directed to amend the Delhi Shops and Establishment Act to increase the threshold of the minimum number of employees from one to 10 for the applicability of the Act and to allow shops/establishments to work 24x7.
Directions were also issued to increase the threshold of workers from 100 to 200 in the Industrial Dispute Act for seeking permission for closure.
LG and CM asked the fire department to empanel agencies for a third-party audit. "Large commercial and industrial establishments may be allowed to get NOC on the audit certificate of empanelled agencies. Small establishments may be given an option for third-party audit.
An expression of interest can be floated immediately," the official said. It was also stressed that the Delhi Pollution Control Committee should reduce the time to give consent to operate to 20 days, after which it should be a deemed approval, and should allow self-certification for MSME in both green and white industries.
The revenue department has been asked to give a fresh look at section 81 and 33 of the Delhi Land Reforms Act, which make the transfer and sale of agricultural land and mutation almost impossible. The Information Technology Department was instructed to make a single-window portal for all kinds of NOCs.

"All parties should create a common minimum program to address issue of illegal immigrants": Delhi Assembly Speaker

New Delhi [India], July 12 (ANI): Delhi Assembly Speaker Vijender Gupta called upon all political parties to rise above partisan lines and formulate a 'common minimum program' to collectively address the issue of illegal immigrants in the national capital. His remarks came in response to Delhi Lieutenant Governor VK Saxena's recent directive to the Chief Secretary, seeking stricter regulations for the issuance of Aadhaar cards in Delhi. The directive followed reports of a large number of Aadhaar cards being fraudulently obtained by illegal immigrants. Speaking to ANI, the Delhi Assembly Speaker said, 'This (illegal migrants) is a major problem in Delhi. To resolve it, all parties should come together and, rising above politics, create a common minimum program to address this issue collectively.' On Friday, the Principal Secretary to the Delhi Lieutenant Governor, VK Saxena, wrote to the Chief Secretary of the Delhi government, urging the enforcement of stringent regulations regarding Aadhaar issuance in the national capital. In a letter dated July 11, the Principal Secretary highlighted that the illegal immigrants have managed to secure an Aadhaar card on the basis of false documentation or misrepresentation, which, in turn, is adversely impacting local employment. The letter further noted that illegal immigrants are also getting benefits under the welfare schemes of the Centre and State governments, once they get their Aadhar cards. The LG secretariat has asked for strict enforcement by Registrars in issuing Aadhar Cards and directed them to switch to the in-house model of Aadhar enrollment within two months. The Chief Secretary has also been asked to provide a comprehensive list of all Aadhar enrollment centres in the national capital by July 15. The letter reads, 'It has been brought to the attention of the Lt. Governor that during the course of Security Review Meetings, in several instances, illegal immigrants have managed to secure Aadhaar cards on the basis of false documentation or misrepresentation. This has a cascading impact wherein such individuals are able to secure documents which establish Nationality, i.e. Passport and Voter Identity Cards.' 'They also end up availing benefits under Welfare Schemes administered by the Central and State Governments. Having secured Aadhaar documents, the illegal immigrants secure jobs, depressing local labour markets, and adversely impacting local employment. This also has wider ramifications for National Security,' it added. According to the letter, the Delhi government has not complied with UIDAI's directions to shift to an in-house model for Aadhaar enrollment by March 2023. (ANI)

India's oldest water tribunal gets yet another extension after 39 years of unresolved dispute

Nearly four decades after it was constituted, the Ravi and Beas Waters Tribunal — India's oldest active inter-state water dispute tribunal — has been granted yet another one-year extension, effective from August 5. The extension was notified by the Union government and made public on Friday. Formed in April 1986 under the Inter-State River Water Disputes (ISRWD) Act, 1956, the tribunal was tasked with adjudicating water-sharing disputes over the Ravi and Beas rivers among Punjab, Haryana and Rajasthan. Despite forwarding a report in 1987, the tribunal has yet to deliver a final resolution, as the concerned states sought clarifications on several issues, keeping the matter pending for over 39 years. 'The central government, after considering the exigencies of the work involved as pointed out by the tribunal, is of the opinion that it is necessary to extend the period for submission of the further report of the Ravi and Beas Waters Tribunal by one year,' read the official notification. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Sharp Design, Smoother Drives. The outcome of the tribunal's final report is expected to play a crucial role in resolving the decades-long SYL impasse, as the canal pertains directly to the sharing of Ravi-Beas waters. The Ravi and Beas tribunal is one of five such tribunals in India that continue to function far beyond their initial mandates. Others include: Live Events Mahadayi Water Disputes Tribunal (constituted in November 2010) for disputes among Goa, Maharashtra and Karnataka; Krishna Water Disputes Tribunal (constituted in April 2004), the second-oldest, involving Maharashtra, Karnataka and erstwhile Andhra Pradesh; Vansadhara Water Disputes Tribunal (February 2010) between Odisha and Andhra Pradesh; and Mahanadi Water Disputes Tribunal (March 2018) between Odisha and Chhattisgarh.
